Failed K1 Reapplying for a new K1

Timeline

We are reapplying for another K1.

While its a small amount of money, how long is a medical exam good for?

Also the same question about a police certificate?

Its more of a hassle to get the Bangkok so just wondering for future plans as the process goes along.

I'm using an experienced immigration attorney this time. Plus I'm impatient.

The bump we hit will resolve itself very soon. The CO was in error anyway but as I've said, this is a subjective process.

Visa expiration is set six months after the date of the medical. She will need a new medical.

If it isn't difficult, it isn't worth it.

4/28/16: Interview (approved)

Delayed entry due to work

8/12/16: POE Detroit

 

9/4/16: Wedding!

9/9/16: I485/I131/I765 sent

9/14/16: Received 3xNOAs by text/e-mail (day 2)

9/14-18/16: Received 3xpaper NOAs 

9/23/16: Received biometrics appointment letter (day 11)

10/3/16: Biometrics appointment (day 19)

11/4/16: EAD+AP approved (day 53)

11/16/16: EAD status changed to card shipped (day 65)

11/17/16: EAD/AP combo card received (day 66)

12/30/16: Notice of interview scheduled (day 109)

2/1/17: AOS interview (day 142) - APPROVED

2/8/17: GC received (day 150)

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

Expedite request for EAD/AP Aug 3, 2016, Aug10 notification >request was received, assigned, completed. RFE letter requesting evidence for expedite, docs faxed Aug18

*Service request for I-485 Aug 3, 2016, Aug11 notification> request was assigned. Service request Dec 2, 2016.
AOS Interview letter received Aug 12, 2016

AOS Interview September 21, 2016.

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Medical is only valid for 6 months for the purpose of getting the K-1 visa.

Revisions to Visa Medical Examination Validities http://travel.state.gov/content/dam/visas/policy_updates/CDC_Revisions_to_Visa_Medical_Examinations%20%2802-2015%29.pdf

Per 9 FAM 40.11, notwithstanding the provisions of INA 221(C ), visa validity must be limited to the validity of the medical examination.

2. Medical examinations will be valid for six months for individuals with the following conditions:
a. No Class (i.e. No Apparent Defect, Disease, or Disability);
b. Class A, Other than TB;
c. Class B2 LTBI;
d. Class B3 TB (Contact Evaluation);
e. Class B, all except TB, including specific Class B conditions; and
f. Class B Other conditions.

3. Medical examinations will be valid for three months for individuals with the following conditions:
a. Class A TB with Waiver;
b. Class B1 TB, Pulmonary;
c. Class B1 TB, Extrapulmonary; and
d. HIV infection (with or without a TB Class).

FYI lawyers can often slow down the process.

What do you think the lawyer can do that you can't do yourself? You realize he's just going to ask you for money to fill out exactly the same forms you filled out the first time right?

I really wouldn't bother with another K-1. IMBRA reviews aren't a common thing and are not something to mess around with.

Unless you now know why it was sent for review to expire (you claimed you didn't in the other thread) and have a way of addressing the issue, I can't see how you are going to be any more successful this time around.

why were u denied the 1st time?

He said in his last thread that the application was returned for IMBRA review. He also had an order of protection that expires on 8/02/2016 according to his other thread.
