21 years old daughter filling a petition for a father who is living in USA

Timeline

My daughter who is 21 years old and US citizen (she get the citizenship from her mother who married an american citizen) is petitioning me,

I came with tourist visa and stay,

I've been working here during that time and present my taxes with my Etin number,

I do not have any criminal record (besides the parking tickets)

I'm divorced from her mother 10 years ago and I'm single since then,

My daughter lives in Florida and I live in California

My daughter already filled out the I-130 which address will be the best?

Should I request the adjust of my immigration status with the I-130?

Why you did not submit the I-485 along with the I-130? You can receive your Green card trough adjustment of status.

If she just filed the I-130 you must attend the interview abroad,but because your visa expired then you will have a bar for 3/10 years to return to the U.S. .There is no waiver available to parents of a U.S Citizen.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

when should send my fingers print from the biometric services? Where to take the fingerprint test?

What about the affidavit? my daughter is in college

Is another documents or copies to present with the I-485?

she should have sent the whole adjustment of status packet, the i130 alone does nothing, so have her send the whole packet along with a copy of the i130,

she should keep copies of everything she sends.

once the i765 is approved, they will send you a date to have your fingerprints takes, there are 2 sets of fingerprints, one for the i485 for the FBI and one for the EAD work permit/Advance parole

since she doesn't work, she will need a joint sponsor, your daughter has to fill out the i864 affidavit of support regardless of no income and attach a letter stating why she isn't required to file taxes. her joint sponsor will be the one covering you

you should have waited until she had everything ready to send all together, now there will be delays

So you just want to play the system. you are working illegally, she lives in Florida and you live in CA, why would it be the point to provide you with a GC if you 2 are not even living in the same coast?

At least he's paying his taxes, unlike a lot of legal residents who aren't. He is not in a relationship with his petitioner, so he's not required to live with or near her plus she's in college so it shouldn't matter.

OP might want to keep all those tax records for his interview as it will be brought up and will look good on his part for paying taxes illegal or not.

Why is it relevant where a parent lives compared to a child? It is normal that parents and children do not live together.

And I don't see any "playing" of any "system". What they are applying for is completely straightforward and legitimate.

You may want to understand the system before accusing someone of playing it.

This man's daughter has every right to sponsor him for immigration if she wishes. He does not need to live with her.
