I-130 question regrading sisters husband and kids

My wife is filing an I-130 to bring her sister to the USA. Her sister is married with 2 underaged kids. My wife wants to bring her sister and kids but not her husband at the moment. My question is does the husband need to be listed on the I-130 form if he is not being petitioned for? Also do we need to provide copies of the kids birth certificates when we initially file the I-130? The form does not seem to ask for them. Any assistance is greatly appreciated.

If it asks for the spouse name you have to provide it even if they are not wanting a visa. As to the birth certificates I don't know but probably. Does she know it is currently a 23 year wait?

LOL....I am pretty sure its not 23 years...but yes I know its at least 4-5 yrs before they even process it. Thanks for your reply. If someone else has more info I would appreciate all replies, thanks.

You sure about the wait times? Look it up, over 20 years...

maybe the i130 will take a few years, but the total wait is 23 years, so the children will have aged out, the only one who will be able to accompany her is her husband if she is from the Philippines

so she should definitely list her husband and her children, even though they age out

there are two bulletins, the uscis bulletin regarding the service center is where only the i130 is processed

once the i130 is approved, the i130 will be sent to the National Visa Center or NVC, where it will be stored until a visa is available

so that's where the wait begins

for Mexico and Philippines, the wait is over 20 years
