You need to apply for removal of conditions within 90 days of your card expiring.

Have a look at all the monthly I-751 threads to see how long the process takes. If you are living in New York, your I-751 will be adjudicated in VSC and currently VSC is taking 10 - 12 months to approve case

so they will extend my current green card(CR)when they call me for finger printing so i can travel abroad to my home country or i have to wait for approval of my i-751?

They extend your green card with the NOA1. You will have biometrics here in the USA as well. Yes you can travel.

USCIS will mail you the NOA1 extension letter before they mail you a biometric notice. You can travel with the extension letter in hand, your expired green card and your Pakistani passport.

i am sending my i-751 to the following address : I live in new york

USCIS Vermont Service Center

P.O. Box 200

St. Albans, VT 05479-0001

my supporting docs are:

1-Combined tax returns(husband&wife)

2-joint bank account statement

3-affidavit from my brother in law

i just want to ask from you ..is everything is correct?

This isn't much evidence, do you have any more? Such as but not limited to leases, mortgage, deeds, insurance, utility bills, drivers licenses, car lease or loan agreement, wills, medical powers of attorney.

Hi again, I don't want to scare you but what you have listed now is insufficient evidence. If you provide just those 3, you are very likely to get RFE and/or interview. Please supplement your I-751 package with more evidence such as the examples that can be found on VJ's Guide here. Also, instead of providing tax returns, provide tax transcripts that you can get for free either via mail or in person at your local IRS office.

Also, make sure that all your evidence spans from the time of your marriage to the time of your filing. This is very, very important. Good luck.

Hi,

Unfortunately, i don't have much evidence because i am living with my in laws, utilities bills, lease and other things are by the name of my brother in law. Me and my wife are living with them since i came to USA 2014 but we have plenty of family photos, can get more than 2 affidavits from my other family members. and also do i need to add cover letter with my package? and how i can get my tax returns transcript from IRS and how many days it take to received by mail? because my 90 days are starting from 25 of july and my green is going to expire on 25 October, 2016

I included a cover letter explaining all the evidence I had enclosed, you could use yours to explain why you do not have leases or utility bills.

Do you have a cell phone plan, is it a family plan? Send in copies of the bills if both of your names are on it.

Go to the IRS website and it will have a link there, it took a couple of weeks for us to get ours.

In the affidavit from your brother in law does he state that you live with him and do not have a lease agreement and that he pays all the bills so that is why you are not on them?

Do you have a drivers license? Does your spouse? If not can you both get state ID from the DMV?

You and your wife would have seperate DMV IDs or driving licenses. But both would show the same address where you live. So include copies of the DMV IDs or DLs.

Include copies of anything that has both you and your wife's name on it. Include copies of all bank statements (with both your names) for the past 2 years.

Here is the link for getting tax transcripts from IRS. You can get the transcripts online immediately.
