Mother has visitor visa

Timeline

Mother has visitor visa, how and what's the procedure so that shortest amount of time is spent in obtaining immigrant visa.

1- should she come and I file i-130,

2- should i-140 should be filed with AOS,

3- file i-130 and just do it the longest way?

What are the other options?

Sounds like she's not in the usa right now, option 3 is your only legal option.

1. No. It's visa fraud to enter the US on a tourist visa with the intent to immigrate. If your mother was already in the US, then changing her intent would not be a problem. Since she is currently outside the US, the preconceived intent to immigrate to use her visitor visa to enter is visa fraud.

2. No. It's not needed.

3. Yes, this is the legal way to do it.

Go with option 3 since it's the only legal option at this point.

As mentioned, 3 is the only option. The process only takes about a year, and she can visit on her tourist visa during that time to look for a place to live and so on, but she cannot stay here/ work/ immigrate.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

As others have stated Go with option 3. I know option 1 sounds enticing and quick way to but it will turn out to be a nightmare. It is actually faster to get approved outside the USA then inside it. They take months - years to schedule immigration hearings and such.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
