sent I-130 without supporting documents

Timeline

I naively sent an I-130 petition without supporting documents to the Chicago Lockbox. I only sent the I-130 and two Biographical G-325A forms. One month later I received an email stating the case was accepted and application routed to USCIS Nebraska Service Center for processing. I received the I-797C shortly after that included the case number, priority date and listed the name and birthdate of my spouse. Should I send all supporting documents now or wait until they send me a request for evidence? The case status currently only shows “case was received”. My priority date is May 5, 2016. Thanks for any advice.

Yes.

I have never heard of this maybe someone else has...i know they send RFE when something is missing not sure what they do when all is missing...

Evrryone makes mistake, just wait for the rfe...the missing marriage certificate and proof of citizenship will be the main reason for the rfe. While you wait for that rfe just gather the rest of the missing docs ready to go when that time comes.

I think the main thing is the missing check/fee. Just have to wait to see how this is handled. OP, it was suggested in your earlier post that you read and study the guides so you know what to prepare. That is very important. Good Luck!

I did send the check and it was cashed. I will just wait for the RFE and hope it doesn't cause too much delay. Thanks for all the replies. :rolleyes:

I have heard of it, in fact I don't know if it is still the case, but Nordic and British DCFs were specifically told not to send evidence. Our whole CR1 was approved with no evidence, but it was a special case. There have been regular lockbox I-130s approved without evidence in the past as well. It is good practice to send evidence with the I-130 for a variety of reasons, but just because it isn't often discussed doesn't mean it doesn't happen.

A RFE will come for the other things specifically.

Edited to say that I apparently misread the first part as just missing the "supporting evidence" of a bonafide marriage.

You do need to send the marriage certificate, any divorce decrees, proof of citizenship, and the passport photos. Those aren't "bona fide marriage" evidence, those are required things. An RFE will be sent for them. However, when the RFE will happen? Who knows? Could be in a few weeks or not until someone actually goes to adjudicate the file and realizes it's all missing 5 months down the road.

My petitioner did called Uscis office before she se t the I-130 and what they said was that she should send only I-130 with G-325 only,if they need anything then they will contact her.

Not even a marriage certificate? I mean, it makes sense that if you petitioning for your spouse to enter the country and obtain residency you would need to provide proof that you are indeed married to that individual.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes, I understand it makes sense. I didn't read the form instructions carefully, I assumed the pertinent documents would be requested later.
