Need advice on the affidavit of support

My fiancé (the petitioner) is on disability and falls just short of the 100% poverty guideline amount when considering his income and assets. Is it allowable for me to send him some of my cash savings for him to use when filling out the I-134? How is the consulate likely to view this?

I've seen people suggest obtaining a large amount of money just to satisfy that requirement looks bad, as someone could just borrow money from somewhere for a short amount of time and give it back. However this is money that I bring to the relationship anyway and intend to use to support myself whilst looking for work. What's mine is his.

It looks bad because the US Embassy is well aware of money moving from one person to another to trick the US Embassy into believing it belongs to the recipient.

While you may view it as what's your is his; another person may view it as you paying him for a fake marriage and green card.

Have you also considered that more than $2000 in an account may put his disability payment at risk? There are rules for getting disability payments.

Get a joint sponsor if you can because your fiancé will need to meet the 125% poverty line to apply for a green card for you.

Yeah I can see that it can be looked at that way. It's frustrating considering that people can 'self-sponsor' (if you can call it that) through the London embassy.

When you need to meet the 125% for AOS, is it true that my assets can then be considered?

He is receiving SSDI, if I'm not mistaken, that one isn't means tested?

The US citizen can receive any means tested benefit. You as the immigrant is not allowed to receive certain means tested benefits.

There are limits on assets to receive SSI. Too much cash may disqualify him for SSI. This has nothing to do with the Affidavit of Support for you to immigrate. This has to deal with eligiblty for SSI.

Google $2000 SSI.

Yeah, the SSI stuff does not apply to him. He is on SSDI. They are different, and his is not a need-based, public assistance benefit.

When you are applying for AOS, the spouse/intending immigrant's assets can be listed on the I-864.

You can always contact your consulate and ask whether or not your assets could be used for the financial support requirement.
