My fiance and I are about to start the process to apply for a fiance visa in a few months. He is 29 and I am 48. I am worried because I have been reading that a large age gap may be a reason for visa denial. We have been together for four years and are very much in love. He is currently in Haiti and I am in the US. What type of documentation should we have that will help our case? Thank you!

Thread is moved from Tourist Visas forum to the K-1 Process forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Age difference might definitely come into play in decision making and it's up to you to clear the officer's doubt with lots of evidences of bonafide relationship,

You said you two have been together for four years. You mean you two have been in a relationship for four years or physically living together?

How many times have you visited him? The best thing you can do is have lots of face to face time. You should read the k-1 guides and see what they recommend. You should also include your relationship evidence in your initial packet and then try to add more from between filing and the interview. Do either of you have children? The Haitian embassy has a history of denying beneficiaries who have children. That may have changed but it was a trend a couple of years ago. If he has a child, I'd highly recommend being outside the embassy (and send in your passport with him) during the interview. Getting approved is very do-able just include the recommended evidence in the guide in the initial packet.

I have visited him seven times and will be going again in June and he will be coming here in July to do a medical internship on a tourist visa. I don't have all of the receipts from the hotels, etc., but I do know two of the owners of the hotels, so I am going to contact them and see if they will write a letter. I do have two children, but by the time we file they will be 19 and 21. He does not have children. Will this affect the embassy's decision? If so, what can I do to help our case and decrease the chance of being denied? Should I still be outside the embassy when he gets his interview? Any help you can give would be appreciated. Thank you!

I wouldnt worry about the age sooo much Its already there. I would focus on the positive 4 yrs and 7 visits as well as pictures and I would use credit card statements for hotel payments or cash withdrawls vs letters alone since letters can be purchased :D Good luck

You should be fine after dating for 4 years and making 7 visits. It's especially nice that you will be able to introduce him to people you know while he's here on his internship. I'd be sure to get a picture with the two of you with your two kids for him to take to the interview but I wouldn't worry about the kids since they're yours. The trend that I had noticed was only when the beneficiary had children rather than the petitioner. Knowing what I know now, I'd say that you don't have to be at the embassy (they no longer allow the petitioner to attend the interview). I didn't attend my fiancé's interview and we'd only been together for 3 years with 4 visits and it went extremely smoothly. We don't much of an age gap but your visits should make up for any red flags that age might bring up.

Did you find the list of evidence ideas? Plane tickets, copies of passport stamps, receipts for hotels, events, and gifts, photos of you together or with each others' family (label back with names and title, example: Beneficiary's sister), letter from the person conducting your wedding (ours just said that he was licensed in our state and knew that we had to marry within 90 days of beneficiary's arrival and that he was willing to work with us on that), whatsapp/facebook/viber transcripts from different stages in your relationship (make sure that you don't refer to each other as husband or wife), phone bills, etc. I made sure that I highlighted the dates of things that might be easily overlooked otherwise.

I don't have every single plane ticket and hotel receipt, but I have several credit card statements of hotel visits, but not the airfare receipt of those visits I also have two airfare receipts, but not the hotel receipts. So basically I have documentation of the visits, but just not the airfare AND hotel receipts for each visit. DOes that make sense? Should I get letters and pictures from family members he meets this summer? I will also be visiting him in June for a few days.

He has Facebook chats as far back as when we started dating four years a go. When I was trying to save them I accidentally deleted them (Yeah, I was so upset about it); however, I now know how to save them and print so I will start that now. Can we just print them from his facebook account when he visits this summer? Most of our communication is by phone just because there have been periods in our relationship where he hasn't had internet and in Haiti the internet does not always work properly. We have pretty much talked every day for four years. I have all of those records, but a lot of them were made through Digicel and don't show up on my phone bill. Can I just print off bank and credit card statements showing that Digicel minutes were purchased and just explain that in my documentation? I do have some phone calls during that time, but they are only for 1- 2 minutes, just where i called him and asked him to call me back because it was cheaper for me to purchase Digicel minutes and just put on his phone. How far back do I need to provide phone bills for? My phone company started a new international plan a while back and I can now call him for only .10 a minute so for sure I have that documentation. What about email, facebook messages, and whatsapp messages? You said to have transcripts by stages, what do you mean by that? Do I not need to print the entire conversations? Thanks for your help!

Totally different when the man is older. Also the younger woman is still of child bearing age.

Also in the phillipines this is very common and cultural accepted. Big difference.

You can only give them what you have so if you only have hotel receipts for 4 trips, send copies of those. If you only have tickets from 3 trips, send those. Copy the pages in your passport showing the visits and highlight the dates... you can even write on the copy something like "trip #2 June 2nd thru June 10th." You can also organize the tickets and hotel receipts either chronically or by category. If I had a ticket and/or a hotel receipt for each trip, I'd probably go chronically.

By stages I meant taking the transcriptions from Facebook or whatsapp or whatever and choosing less than 10 days per year to print and include. I didn't front load my app (didn't know I could or should) so for the interview I sent 3 days per month of transcripts for the 6 months that I had (99 pages). You might want to include a day when you discussed having children. Marriage in Haitian culture is often assumed to be for having kids. So showing them that you have discussed this and that both of you are in agreement about it is good. And yes, you can print it while he's here. We didn't have any phone bills but that wasn't even mentioned. Be sure to include the ones you have lately and feel free to explain why they're so limited.

If my husband had visited the USA before his K-1 interview, we would have included photos of him with my parents, him with my siblings, him with my kids, him and I with the pastor marrying us. Shoot, I probably would have done the whole professional engagement photo session (more because I wanted them than for immigration). My husband and I wrote (snail mail) letters which we included in our packet. So naturally we included the letter my mom wrote him and the picture my niece (who was 6) drew of him and I. Those types of things show that your family is aware of your relationship and supportive of you. I chose to have my mom write him rather than a statement to the embassy. I felt that it was more personal and would serve a dual purpose of making him more comfortable and being evidence.

Sorry I write so much. I think you have plenty of evidence. You just need to get it printed and then organized. Be sure to include a cover letter with your application that lists your evidence. If you think your evidence is weak in one area, then work on it after filing and before the interview. And enjoy his visit! You're so blessed to have that opportunity together. Enjoy being engaged and in the USA. Do lots of fun stuff together, take lots of pictures, and save your receipts.
