What happens after I-751 has expired?

Hello everyone,

I was just wondering what will happen if I do not receive any action on my adjustment of status once the 1-year extension has expired?

Is the responsibility on me to request for another I-751 extension?

I am so frustrated with how slow the process is.

If you are still married to your spouse you can file for citizenship which will force them to adjudicate your I-751 application. Otherwise you can contact your ombudsman. Doing so seems to force their hand as well. You could also contact USCIS and speak with a Tier 2 person about your case and ask about getting a stamp on your passport which extends your status.

You should make an Info Pass appoint BEFORE the extension expires and get them to put an I-551 stamp in your passport. From what I've read this will extend the extension. This would be in addition to filing for citizenship. Wishing us both good luck and a speedy resolution of ROC!

Thank you, my notice of action date was 06/22/2015 and my green card will expire in September.

So I will submit a request before my green card expires in September. Currently Vermont is processing Jun 1st 2015 and before.

Nothing. You remain a permanent resident as long as ROC is pending. (And even if it is denied, you remain a permanent resident until an immigration judge finally deports you.) It's just your temporary proof of permanent residency that has expired. If you want to continue to have proof, you can get an I-551 stamp. But that's just the proof. Your status is not affected either way.

When we at eight months of hearing nothing, nada, zilch from CSC and swinging in the wind (waiting), we formulated a plan of eliciting the assistance of the CIS Ombudsman office (CISOMB). While waiting for them to investigate our case, and if we were within 100 days of the one year extension letter expiring, we were going to make an info pass appointment and get my wife and stepson's passports stamped with a temporary I-551 stamp.

Interestingly two weeks after the notification of the involvement of the CISOMB, CSC bestowed a RFE upon us. I suspect that CISOMB rattled somebody's cage at CSC. The whole scenario seemed too coincidental , not to consider the RFE was a CSC quid pro quo reaction to our request for CISOMB assistance. Our RFE response was submitted after a month of scraping through our files for more "marriage bonafides." Two weeks after our RFE submission, the online status changed to "Card(s) in production."

In our RFE cover letter, I ask that a decision be rendered, one way or the other, just do it! We were ready for an interview, and were preliminary discussion with an immigration lawyer, preparing for a hearing before an immigration judge. We were so done with CSC and USCIS and their nonsense, our judge family wanted to get on with our lives. They treat families as playthings, with no regard to the rule of law or their own adjudication manuals.

My advice, get the CISOMB involved, and come out swinging, they are all paper tigers.

The CIS Ombudsman do seem to be one of the few agencies with the power to compel action from USCIS.

I know they were basically my last throw of the dice to try and correct USCIS' administrative errors on my case, and ultimately did so.

You must be married for at least two years on the day of either your I-485 approval (for AoS) or PoE (for entry on an immigrant visa) to be eligible to go straight to a ten year unconditional green card; there is no wiggle room or latitude.

I would seriously consider making an Infopass appointment to see what is going on with your case, because it if it was us we would be worrying about my wife.

Also I love how you have a picture of Durian as your profile picture. My wife who is from the Southern Philippines LOVES Durian. I hate it but I have gotten used to the awful smell.

Hi, thank you for all your support and suggestions. I wanted to request for case status online but when I keyed in the information, I was informed by the site that my case was within the processing time and to try again later. I have called USCIS twice and was told by the agent the same information that I can find online and I was informed to wait for my turn.

When is a good time to get CIS Omnibus involved?

I am just afraid that I will get the same answer again, "they are backlogged and they are currently processing cases Jun 1st 2015 or earlier, your case is late June, your patience is highly appreciated."

I love all Durians (Chanee, Monthong, Ganyao). I have frozen Durians in my freezer.

How can you apply for naturalisation if you have a CGC ? That kinda implies that even with a 1 year ROC extension you've still not reached the 5 years that a LPR needs to become a USC
