Timeline

Fellow visa journers, I'm hoping you can help me.

I am a USC. My wife came to the US on a B1 visa. We got married 07/31/2015. We applied for AOS and EA in August, 2015. Our priority date is 08/23/2015.

The process was very smooth up to the interview. She got her EA, SSC, DL, etc, and is currently working.

The AOS interview was on 01/07/2016 at the Chicago office. It went well, the IO was very positive and made it sound like we'd have the GC within days. She did not, however, approve or deny the application and she didn't give us any paperwork.

As of today, we have NO idea what's going on with the AOS application.

We tried NCSC tier 1 and tier 2 requests to get status updates and we had two InfoPass appointments, all to no avail. We submitted a request with the Ombudsman and we're waiting to hear back on that. We've also wrote our senators and representatives.

Basically, the response we got from USCIS is "it's going to take as long as it takes."

Is there something else we can do?

short answer: No.

yeah, that sounds really weird, not getting approved after 4 months!

Why does everyone want to file a case against USCIS?

You did all you could, now wait and see what Ombudsman and your congressmen say, be patient a little longer. Each case is like a fingerprint, no two

alike. Some go very fast, some not so fast, some I've seen last a few years....

Sent: 9/12/16: I-130 + I-485 + I-765 (USPS)

Delivered: Sept. 15th 2016 to Chicago Lock Box

Interview Feb  21st, 2018 for I-485

Interview  May 13th, 2019 for I-130 Stokes interview ( 2 minutes)

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

You have in country AP. You wait. The other option is that they deny you. She has EAD and AP so she can live normally in the mean time.

Your wife adjusted from B1. B1s are a tourist visa and not meant for marriage and as a matter of fact many people on here feel strongly about being allowed to AOS from B1.

B1 and F1 AOS's take longer than K-1 AOS, are de facto subject to more scrutiny and couples have had USCIS officials knock on their doors at 8am to check if there are 2 wet towels in the house.

No, you can't file a case against USCIS. The don't owe the beneficiary jack as they are not a citizen, yet and in any case, processing times are not guaranteed and immigration law is not contract law.

You can always renew her EAD and AP. I don't see why you need a lawyer unless you have some other complications.

You had an interview; everything went well. You have contacted the congressman and senator. There's nothing else you can do. You wait.

I am adjusting from a K1 and also had my interview in Jan 2016 (1/10/2016)I am waiting also for a response. I was instructed not to contact USCIS for 120 days after the interview. I contacted them today and a service request was made. One thing I have learnt throughout this entire process is patience. It's frustrating I know.

I've seen cases on VJ when K-1 AOS took 8-10 months (especially if interview waiver is granted). In contrast, my AOS from VWP case took 3 & half months. So I really don't think there is a hard and fast rule about K1 AOS being quicker.
