Timeline

My wife and I were just married this past weekend and now need to go through the process of green card. Her visa expires at the end of the month. Wondering if anyone has dealt with same scenario. She came here on a tourist visa to see me and we decided why not get married. Hope someone could lend some help. Thank you. She is from Ireland.

Thank you for helping. We have all the paperwork almost completed but we were just informed she needs to take a medical examination for the i-485. Can we send in that form before she has that done then send in the results after?

Basically we need to get these forms in ASAP before her visa expires at the end of the month. We really do not want to separate again.

You don't have to send the forms before her stay is up. Overstay is forgiven for spouses of USCs.

Overstay is not penalised at adjudication for immediate relatives of a US citizen, such as a spouse.

You don't have to submit the I-693 medical with the I-485, though this may trigger an RFE. If it doesn't, make sure you take a completed and sealed I-693 to the interview for the officer to review.

Are you a US citizen? If yes, then file for an Adjustment of Status. It doesn't matter that her visa is expiring if you file for AOS. Read the Guides.

Send in the complete I-485 with medical...do not worry about the overstay now...but try to do it asap...look for some Civil Surgeons in your area and try to find the one which does not rip you off.Be ready for the Interview and explain the Officer since she came to see you,I think she didn't mention that she is going to see her fiance or boyfriend during her Visa Interview or POE,otherwise she wouldn't be here.So be prepared to answer all the questions as well.

The way we did it is we found a USCIS approved doctor to do the medical exam for us before we send off the package (https://my.uscis.gov/findadoctor). From booking an appointment to completing the form/examination took maybe two weeks including getting vaccinations and blood work done but it cost us $500. But we were able to send it with the I-485 package before my I-94 expired. Since you have until the end of the month still before her visa expires you might still have the time to do the medical exam before sending off your package provided you don't have major complications with the medical exam. That said, I'm a newbie here as well so I don't know whether that was the correct way to go about it but another VJ member might be able to confirm.

Not always true. My now husband (was boyfriend when he first entered US on VWP) was honest and admitted entrance when he told agents he was visiting me, as his girlfriend. We married the first time he visited and when he departed and came back for more visits, he always told agents that he was visiting me, his wife and never had a problem. At our interview we never had to explain why he decided to stay and adjust, or why we married here in the states while he was visiting.

Huh? My fiance has visited me in the U.S. twice and both times he was honest and told CBP he was there to see me!
