(Please help) Not in the system after filing Fee waiver and 751

Hi!

I am so worried and nervous after talking to the USCIS call center agent.

I submitted I 751 (To remove condition on my green card) and 912 (To waive the fee) on April 6th.

My 2year temporary green card expired on April 18th.

I haven't heard back from USCIS and I called them today because it has been a month to check on my status.

They said that they can't find anything about my case on the system. There is nothing on the system.

Is it possible that the mail got lost or is it taking longer because I filed for fee waiver (But if so, how come it is not even in the system? Because it is not in the system, I also don't have any receipt number).

I have to go out of the country after a month, and after reading articles about how temporary green card holders can be deported, I am freaking out right now.

My husband is saying that may be we should talk to a lawyer but I would like to know if any of you had similar experiences as mine before. (How long did it take to receive receipt number from USCIS when you filed fee waiver?)

Do you have a receipt from either the USPS or UPS (or however you sent the information) of delivery to the USCIS service center? If so, I would make an InfoPass appointment with that confirmation. From what I understand you would be able to re-apply as long as you have that confirmation that you sent the original package on time before your CDC expired.

Also, like what Transborderwife said, do not leave the country until you get things sorted out. You more than likely will not be able to get back in.

Do you have confirmation that your package was received at the CSC? If so, what date was your package received? Do you have a tracking number for your packet?

I think (at this point) people whose packages were received at CSC prior to April 15th have had their checks cashed. But since you filed a Fee Waiver, your packet might have been routed to a different desk.

In the meantime, make an Infopass at your local ASC and take your mailing receipt with you when you go. Perhaps they might be able to stamp your passport (but not sure).

Yes Thank god I kept the tracking receipt.

Should I just send in another application without fee waiver but include a letter explaining my situation and a check?

No - don't send in another copy yet. If your tracking receipt says they got your package, then it just hasn't been entered into the system yet - probably because of the fee waiver. I don't think they will even deal with you until your package has been there for 30 days. Call them again 30 days after it says they got your packet, and tell them:

1. Your tracking receipt says the packet arrived on xx-xx-2016.

2. It has been 30 days from the receipt of delivery, and you have not gotten your NOA1 yet.

3. Ask what are your next steps are (get them to tell you exactly what to do).

If you MUST travel, then tell them that you must leave the country on xx-xx-2016. Ask if you should make an INFOPASS appointment to get a new I-551 stamped in your passport.

Good luck. I fully understand the "scared and nervous" part.

Thank you so much for the help. I feel so relieved after reading your comments.

I called the USCIS this morning because it has been 30 days already. I sent it on April 5th and today(May 6th) was the 30th days since the tracking said it was delivered to California Laguna center.

They said they can not tell me why it is not in the system. The agent seemed to think that whether it was rejected or it is being reviewed it must still be in the system.

I will make INFOPASS appointment and try to meet up with the officer in person.

Although you should have heard from them by now, the fee waiver definitely slows the process down. They decide first if they grant it. You only get a case number & NOA1 AFTER they decide to grant it.

Thank you everyone! I finally got the NOA. I still haven't gotten biometric appointment and It makes me concerned because I will leave the country for 3 months in early June.

I had my passport stamped and hopefully i won't have any problem returning to the country. :( Immigration matter always makes me nervous.

When I check my case status using Receipt number on NOA I received, it says it is not valid. I assume that it will be in the system once I receive biometric appointment date.

Thank you so much for your great advice and help. :)

Will also update on biometric dates and other dates that I will receive.

In the case of I-751 the case number on the NOA1 is useless for checking on your case status. Use the case number from the biometrics letter once you receive it.
