Can we apply for advanced parole w/o applying aos in k1 visa?

Timeline

When you apply for AOS you can apply for AP and EAD at the same time. You cannot file AP alone.

K-1 Visa Timeline

I-129F Received : 2014-08-29

NOA1 : 2014-09-03

I-129F NOA2 : 2014-10-07

NVC Received : 2014-10-30

Paid visa fee $265 : 2014-11-19

Submitted DS-160 Form 2014-11-19

Interview scheduled - 2015-1-22

Visa Issued and in Hand on 2015-1-31!!       

 

AOS Timeline

Mailed out AOS Package to USCIS to Chicago Lockbox with tracking and signature 2015-05-09

Received email and text notification of AOS package 2015-05-15

Received hard copy of NOA1's for 3 AOS packet 2015-05-21

Successful Biometrics walk in SF Field Office on 2015-06-03

Got email notification AOS interview scheduled on 2015-09-03

Green Card in Hand - 2015-10-14!!! YAY!!!

I-751 ( ROC )

July 8, 2017 mailed I-751 packet via USPS Priority Mail with Tracking #

July 10th, 2017 I-751 Package was delivered to PO Box to USCIS Laguna Niguel

July 12, 2017  Check cashed from CSC

July 13, 2017 Received NOA1 in the mail, NOA1 Dated July 10th

February 26, 2018 case transferred to local office

August 17, 2018 Received new extension letter

September 19, 2018 Case transferred and new office has jurisdiction

September 24th, 2018 Received case transfer notice in the mail to Texas Center

October 17, 2018 Card in Production APPROVED!!! WHOO-WHOO!!!!:dance::dance:

NO RFE or Interview on ROC I751!!!

October 22nd, 2018 USPS tracking updated GC to arrive on Oct 24th!

October 23rd, 2018 Green Card in Hand!!

Dec 15th, 2018 Filed online and got NOA1

Dec 21st, 2018 Biometrics Appointment scheduled online scheduled for Jan 9th 2019

Jan 2nd, 2019 Successful Biometrics walk in

September 27, 2019 Interview Scheduled for Nov 8, 2019

Thank you, I have a followup question I that case. I know the average time for the green card interview date at the moment is "183" days. When I check the specific office we will be dealing with (in New Orleans, Louisiana) it states the average days to interview is 100. Here's my question, it looks like my wife and I are "lucky" that new Orleans has a decently fast processing time for the green card. What we are wondering is should we assume that the ap and ead will take the avg. 90 days or could we expect it to be processed quicker than the avg 90 days? (I looked for ap and ead statistics for new Orleans but couldn't find any)

Yes, the green card can take up to 6 months or more, however, you MAY (usually) receive the EAD/AP combo card earlier. Currently EAD/AP combo cards are trending at approximately 70 days or so.

I worded my question a little confusing the first time so I'm going to try better. Generally green cards take about 6 months and ap/ead cards 70 days. The 6 months is taken from an average. (some offices process faster than others). My local uscis office has an average of 100 days for issuing green cards. What I'm wondering is this: is there a good chance the ap/ead card will be processed quicker than the average 70 days or is this completely separate from the green card application time frame?

And yes, it's no emergency but my church does some mission work in mexico(that's actually how wife and I met) and we're planning a trip for the end of July. Which means, going by the 70 days avg. we would need to apply ASAP, but we wont have the money for that aplicación for another month. So I'm trying to figure out if we should "kill ourselves" trying to get the money by the end of the month of just let it go and she has to wait to see her family untill December. sorry for the long post, but thanks for all the help.

You choose to pursue the K-1. Waiting for the EAD/AP card is part of the deal. Don't count on getting AP by the end of July. Count on 90 days or more.

When you apply for EAD and AP TOGETHER with the AOS they are included in the price of the AOS. So if you can afford the AOS fee you can afford the EAD and AP too.

I'm aware of that, I was trying to say I don't have the money for aos at the moment but sorry for the confusion. And thank you Harpa, that's more or less what I was wondering

Different issue. Plenty of people make well over the 125% of poverty level needed for AOS.. and still need every cent each month to pay the bills. AOS will need to be part of the immigration budget at some point, of course.

And it amazes me how man couples here on VJ only read up on one step at the time instead of the whole process and save up the money before they even file for K1. Instead they bring their partner over and let them live in immigration status limbo land until they can afford the AOS.
