Hi, I'm new here, my petition was just mailed out today, now the long wait. Me & my fiancé have been together for 2 yrs now, but I'm a lot older than him, by 18 yrs, everything I've read says it won't be an issue, has anyone had this problem when it came time for the approval of the petition? I'm so worried it'll be denied because of our age difference. Thanks

I met someone same case like yours and she was accepted. :) It will depend on the evidence you submitted and your interview. Just be confident and show how truthful and honest you are. Just try to be ready of bringing extra evidence "like pictures and so on" whatever you have during the interview that you have not submitted.

You shouldn't worry about the age difference in terms of getting the petition approved. USCIS are only concerned with the formal requirements.

When it comes time for the visa application and interview at the embassy, that could be more challenging for your country. I understand that the female being older than the man is not common in Pakistani culture? I will not say for sure, why don't you check the regional forum for experiences? I assume you have a lot of relationship evidence which will be helpful?

I am a way more than 18 years older than my husband. The interview at the embassy may be a little rough. He may be interviewed by more than one person. USCIS doesn't care about age so if you have provided the proper evidence they should approve the I-130 without problems. It's the interview in Islamabad that is more important. Study visa journey for others going through that embassy and their experiences. He should know as much about you as possible including info about your former marriages, kids and close family members. They may even ask about your job and car you drive.

I am sorry you said you filed a K-1 not a marriage I-130 my mistake. Still they will most likely ask him very detailed questions and it is up to him to make them believe that he loves you despite the age difference.

Are you still of childbearing age? If you are of an age where becoming pregnant is unlikely or impossible then this could be a cause for concern with the CO at interview if your husband is a lot younger and doesn't yet have children. He will likely be asked how he feels about spending the rest of his life without knowing fatherhood.

This is a bigger issue in some cultures than in others. Many couples here in the UK are childless by choice. That is unheard of in some places.

I do have 2 kids, and no I can't have anymore, my fiancé was aware of this after we met, he has talked to both of my kids and considers them his own. We have talked about adoption though.

Get ready to prove everything and go thru some hoops the others don't have to do

All say NVC will accept copies of marriage certificate but they wanted our original (everything original)

not trying at all to discourage you as you can make it

I did

It really is against our Consititution to discriminate for age and i pointed out that Lasrry King is 26 older than his wife

i wish you had married at the meeting / you may have to do this in future and go the CR1

send me a note if you need anything and i will tell personal age difference

I truly hope you have front loaded the i-129 f with solid proof of your relationship as it is always good to front load the petition with as much proof as you can because,pretty much,the IO decides the outcome of the interview before the beneficiary is ever interviewed.It's always hope for the best but the most important is prepare for the worst. Definitely your case has some red flags as it is not common in Pakistan,for a man to marry a woman,18 years older.You will see people here telling you to not worry but as a matter of fact you do need to worry and start preparing your fiance and yourself for the Interview because it is gonna be very tough.Gather additional proof of relationship and go through the cases of other members who were in similar situation.All the best.

I'm 12 years older and they gave us a hard time. Been with him 4 years married one. I had all our proof front loaded. Now they want more bonifide proofs that it's a real marriage. So make sure you have good evidence. I added him to car insurance, paypal debit card etc etc. Hopefully this and affidavits will work

We are in AP and need to turn these in to find out if he is approved or denied.

7/30/2015 Sent I130 priority mail to have tracking, I suggest you do the same.

1/18/2016 paid aos fee

1/28/2016 review 261 to get iv fee unlocked ( unlocked once I did review,was taking to long)

2/1/ 2016 sent AOS & IV packets together to nvc while I waited for iv fee to open to save time.

2/4/2016 paid IV Fee and waited to do ds260

2/3/2016 nvc received aos and iv packets(scan date)

2/7/2016 ds260 completed and now waiting for cc

When it comes to a large age difference...it truly depends on the culture of the country the beneficiary is from. Large age differences in the Phillipines where the man is older than the woman is very common and no one seems to bat an eye. Its culturally accepted.

Pakistan....where the woman is older than the man...no longer of child bearing age is a concern and not the cultural norm. The beneficiary not able to have biological children of his own is a concern. You cannot think of it as what is acceptable in the USA. You must think of it in middle eastern terms. I am saying this so you can be prepared to deal with it at the embassy stage and have a better chance of approval. Not being prepared...going into it with rose colored glasses...will not help you. So, with that do some research. There have been many many threads started on this topic. Use the search tool and read up! Prepare strong relationship evidence. I'm a strong believer in looking ahead, researching all possibilites and options, and being prepared for every possible outcome.

It really doesn't matter so much how you and your fiance feel about the age difference as much as you must convince the CO that your relationship is real and lasting.

I had a worry too with mine since the Bahamas is a pretty homophobic place, I thought we would have trouble as a same sex couple. But it was very easy and very straight forward it took about 10 minutes and he told me on the spot that I would be approved as soon as he received my medical results. I just kept telling myself that all relationships look different and these officers have to know that by now and that really helped me to stay calm and not fumble about like an idiot :lol: . If they only accepted the average (opposite gender, same race, similar age, etc) couples then I think there would be outrage!

My advice would just be like RoJ10 said, be confident and truthful and the worst that should happen is they might ask for more evidence. But as long as the relationship is true and you guys really do love each other, it should be simple! Good luck!!

  • On Oct 13th AOS status was updated to say that a notice was returned due to post office being unable to deliver it. Tier two told me that it was biometrics or NOA1 (even though I had received both before this date).

  • A few weeks later I received a notice dated Nov 10th, in regards to my call about the Oct 13th notice. The new notice said that there were no RFE's or withholding on my case. So still not sure what this Oct 13th notice was about.

  • Received a letter from a NY office on Dec 23rd (dated Dec 10) stating that my medical was over 1 year old. (At this point my medical was only 7 months old)

  • Teir two submitted an internal service request to which I got a response telling me that I need to respond to RFE ASAP

  • Submitted another service request on 1/6/17. To which I got a response on 1/19/17 stating that my case was pending and is outside of processing time (no mention of RFE)

 

ROC Timeline

10/21/18 - Packet Sent
