Hi,

I want to know if someone could expedite a waiver (is not my case, I have a solo I-212, but I think it works at the same way at this moment), based JUST on the financial hardship. And if someone could do that which proof and arguments was used.

I´ll make the situation fast:

- I´m a medical doctor from Brazil. As everyone could know a little bit, the situation of my country is becoming worse everyday. So, I have 2 jobs to keep my family here and while I´m still able to keep my family is everything fine, because I´m keeping one household (with 90 hours work weekly...) and my husband is keeping his household there. BUT... the situation is so bad that my boss gave me 2 no paid vacation weeks (it was extended already for more 2 and it is a particular hospital...) and my husband started to help me with the bills because the situation is so bad that there are no jobs even for medical doctors! I´m looking for jobs insanely and there´s nothing... nothing... And my husband is starting to struggle to keep me here... If you guys can imagine... a medical doctor receive U$170 for 12h shift in an ER (with nothing together, they don´t give formal jobs for doctors... doctors have to open their own company and provide receipts for them)... And I´m still paying the loan from my university, school for kids, health insurance... :(

I have just a pending I-212. The office of my POE made a mistake and received that just after 6 months. They just accepted that because I involved my Senator Liaison on it. If not... Ugh... I think I was still about to try...

I´m about to finish the NVC part...

Do you guys think that they can accept and expedite with that?

I wish I could have it done until my interview... The money is finishing and we don´t know what to do.

I´ll appreciate any kind of advice and opinion.

The ironic ones, please... Don´t mess or make fun from the situation.

the financial hardship has to be for the US citizen, not for you as the beneficiary or your family in Brazil. You will not get a expedite because your family in Brazil needs you to come to the US to work to send money back to them.

But my hubby who is the USC is sending money and he's struggling because of that... This is the point. We were in a balance until the financial crisis got me. I'm doing my best to don't spend and don't ask for money but is becoming impossible. So I can prove that he's sending money in a big amount to support the family and I can prove that my income went down.

I think to use Financial hardship, you would need to demonstrate that you being in the USA would lessen the financial burden on your husband. Might not be easy to do, especially if you are employed and the cost of living is lower in your country of residence.

Your expenses (student loan, health insurance, etc.) will not disappear because you are here, so that would not support your claim.

Others might have more details about what to include.

And... He's helping just me and the kids who are his direct family. Not my family here in Brazil. This is just about our household, no one else involved.

I think to use Financial hardship, you would need to demonstrate that you being in the USA would lessen the financial burden on your husband. Might not be easy to do, especially if you are employed and the cost of living is lower in your country of residence.

Aw! Our cost of life will go down in a huge way! I know my expenses will not disappear but I'll be able to work there (not as a doctor yet) and pay my particular stuff, and we will be able to get health insurance from his company, we will be able to let the kids at the public school (in Brazil they are really bad so everyone here kill themselves to keep their kids in a particular school), we will have just one rent, not 2, food for him will be cheaper once we will eat all at home and for now he's not cooking for himself... There's a lot of ways that I can prove that our financial life together will make his life easier too.

Besides... Brazil look cheap for foreigners but for you to have an idea... Those mini Oreo that comes in a plastic glass... (Normally cost U$0.99) They cost here more than U$10...

Our money worth a third part of yours but the prices... Omg... Still worth buy abroad for brazilians.

The hardship has to be on the U.S. citizen. The situation in the U.S., not Brazil. We got an expedite for our waiver but it was because my unemployment benefits were ending. I am the U.S. citizen. So I needed my husband here to contribute to the household. I didn't need any proof. I only sent a request in writing and the letter stating the date my benefits would be exhausted.

Our waiver was received by USCIS around August 28 and the expedite was approved around October 10 and his waiver was approved December 17. He entered the U.S. January 12.

No, the kids are not USC...

Me and hubby will gather all the documents to prove his hardship (his expenses for 2 households) and let's see.

Once lone I-212's are be in a black whole, if something come up, will help already.

You say it's difficult finding work as a doctor. Can you do something else?

Sure! I can speak other languages so it helps me to get something different.

When I was a teenager I used to work as a receptionist in events, and I did that in a lawyer office.

But the problem is that there are no jobs available it does not matter in which field.

The country is bankrupted... We are living a situation that when you get a job, they don´t pay your salary... Delays for 2 or 3 months... And the hospital that i work, know my situation (with 2 kids) and they preferred be honest and give me freedom to look for another job or wait until the things get better.
