2015 Taxes DUE TODAY, SSN PENDING???

Hello!

I know I've totally dropped the ball on this by waiting till the LAST minute to file. I was going to mail in the application for my husband's ITIN with our paper taxes, HOWEVER I JUST noticed that he can't apply for an ITIN if he is eligible for a SSN. We applied for the SSN on Friday since he got his EAD, but now I don't know what to do to file our taxes. I can't apply for an extension or file my taxes without him having his SSN or ITIN. I haven't been able to get a hold of ANYONE in ANY tax office (big surprise, right?).

HELP PLEASE! I'm SUPER stressed out and not sure what to do....

Aug 26th, 2015 - Packet 4 received, our interview is set for September 15th!!

Sept 15th, 2015 - APPROVED!

Oct 6th, 2015 - Arrived in Washington

Nov 12th, 2015 – Legally MARRIED!!! ♡

Jan 27th, 2016 - Biometrics appointment

May 4th, 2018 - Tracking indicates package received at CSC. Also mailed out the payment that was forgotten.

May 11th, 2018 – Visa expired...

June 9th, 2018 - Packet returned... didn't check a box in one section, and didn't include a photocopy of my husband's permanent resident card.

If you have a refund due back then no real need to worry about the filing deadline. Although the filing deadline is there for a reason, you would not get penalized if you have a refund due back and you file after the fact.

Unfortunately, you cannot e-File in the same year a SSN (or ITIN) is issued. You would have to send via mail a hardcopy. Next year, you'll be able to e-File.

For the year 2015, you can't simply file jointly with a non-resident alien. That is his IRS designation because he did not have a greencard in 2015 and he was also not present in the US but a couple of months.

For him to file a joint return, you each have to sign a statement saying you wish for him to be treated as a resident alien for tax filing purposes. Sending the statement requires a paper return by mail.

That also means you report all of his income earned in Ireland in 2015. A JOINT return means all income either spouse earned anywhere in the world from Jan 1 to Dec 31.

You could also file as married filing separately, though you almost 100% for sure would get a bigger refund if you file jointly.

The deal with that, is that as of Dec 31, 2015, he was a non-resident alien. So you can file for yourself alone as married filing separately and he not file at all (because as a non-resident with no US income, he's not required to). BUT, it is likely that you'd get a bigger income filing together. That means that you'd have to choose to have him treated as a resident for tax year 2015 (a letter), which choosing to be treated as a resident means that you may be required to pay taxes on your worldwide income. BUT because he was outside of the country for so long during 2015 and because his income is all foreign,it is likely to mostly be excluded from being taxed, and yet you'll still have the double standard deduction given to married couples.

TurboTax and the like cannot do this opting to be treated as resident thing for you (or not that I could force it to anyway), but you can use the tool to walk you through the 1040, and then view the return and use it to guide you in filling out your paper 1040 (which isn't even that hard either, I'm just horrible at math). Then the 2555EZ (he probably qualifies for the EZ form) which was actually really really easy (read the instructions that come along with it). Seriously, if you can DIY US immigration, you 100% can do taxes. I'm never paying for TurboTax again.

23 Dec 2015: Legal marriage

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

27 Apr 2016: Electronic NOA1 for all 3 :dancing:
29 Apr 2016: NOA1 Hardcopy for all 3
29 Jul 2016: Online service request for late EAD (Day 104)
29 Jul 2016: EAD/AP Approved ~3 hours after online service request
04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

11 Sep 2015: Packet 3 emailed from embassy to me, the petitioner (34 days from NOA2).

18 Sep 2015: Medicals complete

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

March 16th, 2015 - He Proposed!!

April 15th, 2015 - Sent the K1 visa packet to Texas

April 18th, 2015 - CVS received our petition

May 28th, 2015 - Request for Evidence...

June 8th, 2015 - RFE received

June 12th, 2015 – K-1 APPROVED!!

July 16th, 2015 - Consulate received package and we received our Packet 3

Aug 11th, 2015 - Packet 3 emailed back

Aug 25th, 2015 - Still haven't received anything back from the embassy, Packet 3 emailed again

Aug 26th, 2015 - Packet 4 received, our interview is set for September 15th!!

Sept 15th, 2015 - APPROVED!

Oct 6th, 2015 - Arrived in Washington

Nov 12th, 2015 – Legally MARRIED!!! ♡

May 5th, 2018 - Tracking indicates payment package received at CSC.

May 11th, 2018 – Visa expired...

June 9th, 2018 - Packet returned... didn't check a box in one section, and didn't include a photocopy of my husband's permanent resident card.
