Is that a good idea to apply for CR1 while K1 is still under administrative processing for 6 months?

Our case has been put under administrative processing for over 6 months now since my finances interview which was on Oct. 2015 we haven't heard anything from USCIS/NVCC/DOS/..they told us it could take up to 6 months for them to notify us, but still no status. So i thought maybe its better to for me to go back to her country and get married there then file for CR1. but i'm not sure if that helps our processing time. We already married now and our case still pending.. This long distance is about to kill both of us..we both suffer from being so far away from each other for over 1 year now..

If Anyone has experienced such situation please share it and those who have knowledge about this type of cases please give us some advises, we would be appreciated.

You are already married?? Then the K-1 case will be cancelled and you'll have to start over with the CR-1.

And please remember CR-1 can be put on AP too. You were on AP for a reason and will most likely just be on AP after the CR-1.

CR-1 takes about a year without the AP...

yep K1 is dead you need to do the CR1.

since you married, then the K1 is irrelevant, the petitioner should withdraw the K1 and start all over by filing the i130 for spousal visa

the k1 is dead because you married

and as said, you still can get an AP with the CR1, it depends on why you got the AP in the first place

Since you have gotten married you will need to file a new petition for a CR1 visa. You may or may not have AP the second time around.

Confused as you say "should i go back and marry?" and then you say you are already married

like the others said if married apply for CR1 and send a letter withdrawing the K1

if not married, forget the K1 and go and marry

just read your timeline and it says you got letter saying it is refused / only thing you can do is marry and file CR 1 and be prepared with more evidence of bona fide marriage

You won't be able to use the K1 visa to enter the U.S. That visa is for fiance/fiancees, not married people. Married folks have to file CR-1 visa.

hmm are you married or not married? If you are you cannot continue with the k-1, it would be fraud. Cr-1 is the only way,


you were here 2 months ago asking how to withdraw the k-1 http://www.visajourney.com/forums/topic/585752-i-need-a-sample-letter-to-withdraw-my-i-129f-petition/#entry8010715 and that is what u need to do

you shot yourself in the foot because now you will have to start over, pay more money and then you will be in AP all over again. Getting married does not solve AP, you just added at least another year in to your journey

In previous threads OP states they received a refusal letter along with AP. Very confusing, AP vs refusal, Married vs not married. DIfficult to give proper advise without knowing real circumstances.
