Hello,

I had a k1 petition filled for me two years ago by my ex and got approved but before my interview at the embassy I found out that he was cheating on me and decided to withdraw my petition.

And I am now with someone else we got married last month after a year of relationship. We have spent three months together face to face.

We are wondering if because of the previous k1 petition it will be better to wait to file for the cr1 or should we join all our proofs of bona-fide relationship and start the process in a month or so ?

I know my ex k1 petition is a red flag. But do we still have a chance to get approved or will we get automatically denied ?

Thanks

You can start any time you like. Be truthful about having had an I-129F petition filed for you before and having cancelled it before interview or receiving a K1 visa.

They may wonder why you're seeking spouses specifically from the USA, but that would be a question for interview, not the USCIS.

Thanks for the reply

So should we join a letter to our petition explaining the situation ?

My husband is well aware of the situation. He helped me so much and pretty much all by himself helped me get back on my feet after what happened with my ex.

Nope. Deal with any questions at the interview and answer the forms truthfully but there's zero need to bring attention.
