Yes, he needs to be added to Part 5 and check "no" for question 5.

You most certainly include him. "all your children"- says the form. Then you check "yes" to living with you & "no" to applying with you. Include his birth certificate as part of your evidence of bona fide marriage.

You need to submit evidence of a bonafide marriage, such as birth certificates of children together, financial statements that span the length of the marriage, etc... The I-751 guide provides good information on what to submit.

Even if your son is from a previous marriage and he doesn't live with you, you would need to put him in your application. If he is from your current spouse, why even think to exclude him? People include gas/electric bills, some 20-30 year olds include wills that they last-second purchase through some website to prove that they are in a bona-fide marriage after all.

A child alone will not be sufficient for the adjudication of your petition but for sure will be major factor.

When I reading the form it sounded as if you only add children if they where also a conditional resident.

It says "list all of your children" & later asks if they are applying with you. That said, this is a common question here on VJ.

Yes, your son needs to be listed on the form even if he's a USC.
