My name is Rick I came to USA on November last year got married following month.before we married my spouse have been abusing me..she even tells me many times that I should go back home..luckily we got married since we married things has not been easy for me from pushinh,shoving and calling me #######..even she forced me into sex sometimes..we filed for aos January and I did my biometric on February first of this month..from last week to this week is another misery of my life..she fingered my left eye when we arguing and slapped me and threaten Me she will call police that I abuse her..despite she's the one abusing me..today I was watching t.v. and she off the tv and told me no more tv for me in this house and she tells Me she's the boss here that whatever she want she decide that she brought me here that she has the power to send Me back to Africa..I'm really confused now.she's heading to court to divorce me and my aos is Stil pending.and I'm just 78 days in USA..pls I need advice of what to do next if she divorce Me despite my aos still pending

You can report for domestic abuse so your immigration won't be affected. That's what I was told when I passed the interview

you should have call it quits return home & be honest with uscis of all this that she

did....I think it would be in ones favor in that case to obtain a tourist visa later. If she

claims you abused her you have probs, its your word against the USC who may have

back up witness to lie (if so) for her

Next time she hits you call the police and fill out a police report. Have evidence of her abuse if you want to use the Vawa.

I dont think OP means "luckily" to have gotten married to immigrate. I believe this is a case of miscommunication due to language barrier. I understood it as they may have had issue of domestic violence which he felt were possibly isolated and forgiven so luckily love prevailed and they married. Only for him to realize she is not remorseful and is a true abuser! Lets not be so quick to question motives bc love is experienced differently by many. I have been in what I thought was love and so blind when others have clearly seen the disaster waiting to happen. Also I would assume it would be harder for a man to come to grasps that he is being physically abused by a woman.

In any case, I choose to believe noone would endure risk of possible death for uncertainty in a foreign country knowningly. Who knows what life he left behind with far and few opportunities as it is in his home country, why should he go home to maybe nothing if he can prove he had good intentions and married for love only to be abused by someone he trusted. Not everyone has family and friends to help one bounce back.

You can file for a green card under the Violence of Women Act (VAWA) by filing I-360. You should file with an attorney to guarantee success.

You will need to provide evidence of the abuse.

Even for a VAWA, one has to prove bona fide marriage as well as the abuse. Regardless of the abuse being the truth or not, I think proving bona fide marriage might be hard due to the short period of co-habitation.
