I-485(AOS) initial evidence request for Birth Certificate

This is the initial evidence they requested from me. However, I sent my "official vital records" (US Embassy in Turkey considers that official paper as a birth certificate) and its english translation together.

I am confused if they are asking "more" evidence or they simply say the official paper and its translation is not what they want ?

attached you can see the letter and the translation of my birth certificate. Anyone can give me any idea?

I tried to upload the letter too but it did not work. Here's the link for it.

Jan 19 2016: Received notice that they received the RFE evidence

Feb 22 2016: Called and found out another RFE was being sent out about birth certificate

Feb 24 2016: Sent in (inextensa versions, not de acta versions) of birth certificates for all children

Mar 02 2016: Received notice that they received the RFE evidence

Mar 11 2016: NVC Process finished, now awaiting interview time slot to be scheduled

Mar 29 2016: Called NVC and found out today they scheduled interview

Apr 01 2016: Received Packet 4 notice via e-mail with interview date

Apr 25 2016: Children received P4 letters in the mail

May 19 2016: Interview

Jun 03 2016: Received Visas

The only thing I can think of is to resend .... and also if you happen to have anything else that might help (*school records, etc or any other thing they say would suffice*) just to help out. But yeah, that is wierd ... they probably just lost your birth certificate .... they did that to me one time .... and I KNOW I had it in the packet ... :)

You should send Formul A (Multi-language Birth certificate)

You should have got this document from Turkish Vital Statistics office with no fee before you moved to the US. Try to ask any Turkish Embassy/Consulate around where you are now to see if they are issuing the same or not.

Although it has same exact info on it, the one you have sent is not a birth cert, it's some kind of family information sheet.

I totally forgot I actually have a Formul A document. It is also apostilled.

This will be my response to the RFE:

Initial evidence section in the instructions for I-485, Application to Register Permanent Residence or Adjust Status states:

“Submit a copy of your foreign birth certificate or other record of your birth that meets the provisions of secondary evidence found in Title 8, Code of Federal Regulations (CFR), 103.2(b)(2).”

Also, according to Department of State website a birth certificate for a Turkish citizen is called “Nufus Kayit Ornegi”.

I plan to send the same document again. I will also include this "Formul A" document as well as the translated copy of my ID Card (translated by the Consulate in Houston) (Turkish ID cards show date and place of birth and parents' names)

I do not think there will be any other official paper out there.

Hey, Pekan. First of all, I'm happy for your greencard. Congrats. I have a question. On your vital record provided by the Turkish Embassy in Houston, in the married section, did they say whether you are married or single on it? Got an rfe for a translated birth certificate and I came here with a K1 visa. Adjusting my status and pending, by the way. After waiting for a long time with a Notice of Potential Interview Waiver I got an RFE for an English translation of my extract vital of record. I got the translation today but the marital status says "single". Would that be a problem?

Hi Turkish Folks,

USCIS may ask RFE upon filing I-485 form adjustment of status. The reason might be if the beneficiary did not submit original birth certificate but instead "late registration birth certificate" along without 2 affidavits. I am wondering if "NUFUS KAYIT ORNEGI" that is given as birth certificate can solely be used as original birth certificate? Have you folks only submitted "NUFUS KAYIT ORNEGI" as birth certificate for adjusting your status "I-485"?

If only "NUFUS KAYIT ORNEGI" can be used then, have you got approval for your status adjustment? I would appreciate if you folks provide feedback with very outmost dated experience.

 

Do we need to translate marriage certificate into English?
