I finally gave up on trying to speak to a real person at USCIS - here's my situation

I already have a Social Security Card in my maiden name (which I got while I was in college).]We got married in PA and my marriage certificate shows my maiden name.

I want to take my husband's name.

I read in one of these forums that people just fill out the forms when adjusting status using their new married name (I-485, I-765, G-325a). Is it okay for me to do this even if my marriage certificate and my SSC show my maiden name?

Also, does that mean my husband fills out the affidavit of support using my new married name?

I would go back to the SS office and change your name to reflect your new married name--you need to bring your marriage certificate to do this. In the AOS application, you should attach copies of your marriage certificate to show that your last name is now the same as your husbands.

As far as the I864, your husband would be filling out the form using his last name, since that's the name that you said you were taking and that's what should be reflected on his SS card as well.

Right, I can go change my social security card to reflect my new name (have to file my papers this week though if I want to file on time so I'll have to mail it in and THEN go to the Soc Sec Office... )

But is it okay that our marriage cert shows my maiden name? We weren't even given the option to use my new married name.

I thought the same thing, my marriage cert doesn't have my new name either. Confused me but our lawyer filed under my new name,

Timeline

First of all, a marriage certificate does function as a legal name change document regardless if there is a section specifically stating the new name. In the locality my wife and I married, there is nothing that specifically states she took my family name, but we filed our AOS in her new name and all cards showed up with that name. As to the SSC, I would suggest waiting for the EAD or GC to change the name as the SSA is not an immigration expert, and many times they will not change the name if the I94 and passport do not match the new name even if you do have a marriage certificate. You can certainly try, but if you wait for the EAD or GC, they will use that to prove legal residency, and you will have no problems changing the name.
