general waiver for multiple filer

Timeline

I have a question? Around 12/12/2013 i filed for my ex husband i-129f petition and it was approved

June 2014. We divorced may 2015. We never did the i-864 not did he attend his interview since we were going throuh a divorce at the time. We got married here in the states. Anyway last year i met a wonderful man and I started the fiance process. This time we are doing the k1 visa since we are engaged and not married. Anyway, i got an RFE since i forgot to send in my waiver for filing multiple i-129 to explain my ex and how now i am engaged to someone else. Anyway, I also made the stupid decision to not cancel my old petition for my ex since my stupid lawyer told me it would cancel out on its own since my ex never showed up for the interview or anything. I never thought i would be going through the NVC again but I truly love my fiance and I known he is diffrent and a great guy. My question is how long will it take to cancell my ex petition? And how can i do that? Do i need to write a letter to NVC or the embassy in mexico where my ex was supposed to be? Does this letter need to be notirized? I also got an RFE for my k1 fiance visa since i am a multiple filer. : ( sad face! I guess i was silly enough to assum my ex petition was cancelled and i assumed i could move on. So since now i have an rfe for a general waiver of why i am filing again. I know its a letter i need to write and respond to NVC with the original RFe blue paper and my evidence. But I am worried the only evidence i have so far is my divorce decree which by the way i did send with my i-130 for my fiance k1 visa. So my questions are? Would i have enough time to cancell my old k3 petition? I have till april 3 2016 to respond to my RFE and will it effect me? Should i wait till my old petition is cancelled before continuing? Because i almost feel that my divorce decree and a letter explaining what happened might be enough? I worry about my withdrawal taking to long and my k1 fiance visa being denied because of it. Will someome please help me? And thank you.

I am so not understanding all these Visas you said you applied for as a K1. If You in the past weren't married than you filed a K1 where does the K3 or I-130 come in. This is really confusing.

Also you got an RFE from USCIS right? You keep talking about NVC which your case would not be there.

You have a lawyer yet they seem to be vividly incompetent if they can't answer these basic issues for you.

You need to write a waiver to file again since you are a multiple filer. And also write a simple letter to withdraw your previous petitions. List them all (the receipt #'s).

If your other cases actually made it all the way to the embassy then email the embassy to withdraw and also write a letter (not email) to NVC and withdraw that petition.

Send your letters to USCIS with your RFE letter so you don;t miss the time-frame.

Sorry, it was late when I wrote my question. But yes I was married before and had to do the k3 visa. Now i am divorced and engaged to a new man. Therefore, i am now in the process of doing the k1 fiance visa but got an RFE since i forgot to send in my general waiver regarding my multiple petitions. Sadly since i have petition in the past for my ex husband now I might get a red flag when I petition for my fiance even if i am divorced and everything.

I have a few diffrent Questions regarding this general waiver for the k1 visa? I am wondering if i need to wait till my petition with my ex has been cancelled in order to proceed with my k1 fiance visa? And if so then how long will it take to cancel? My ex husband process went all the way to his embassy in mexico. Now do i write the letter to withdraw to the nvc or email his embassy? And nope he did not attend his interview since we were getting divorced by then. Also i am worried about the RFE timeline i got to send my waiver and proof? I have till april 2016. Do you think i will have enough time to cancell my ex husband process and get proof within a month or so? I am hoping to send my divorce decree and a letter as proof saying my ex husband petition has been cancelled.

I am just really scarred I will miss my timeline For the RFE and my k1 fiance petition will be denied.

That's what I was telling you to send in all your paperwork with your RFE. You don;t get a second chance. It takes a minute for them to withdraw. It's about you putting it in writing. If you had submitted the letter with your petition it would have been done izzy pizzy. It's not a long drag out process. They just want it in writing.

So send your letter to embassy and NVC just to be safe. But with your RFE have your withdrawal letter and your waiver included.

So,send the withdrawal letter to the NVC with my RFE? Question should i wait till i get my confirmation from NVC that my old process has been cancelled? And when you say it takes a minute do you mean it will take less then a week to hear back that it has been cancelled? Sorry I just feel a little pressude since i dont have much time to respond to my RFE.

No you have to address the RFE issues with USCIS isn;t that where the RFE came from?

I was saying you can write a letter of withdrawal to embassy (email them) and email NVC .

means send it off all at same time.

My only question is how long will it take the embassy to respond that they have received my petition to withdraw my ex husband old petition? is this where minutes take place? like is it fast?

reason i ask is because I am in a strict time line

You aren't listening to me. Just email it's a simple process you are wasting time. Sorry to be blunt but you just need to email. The important fact is the letter you will attach to your RFE they will see you want to withdraw and proceed. No one is going to contact you and tell you anything.

OP, you are very confused.

You send the RFE waiver request to the address showing on the RFE letter, it gives instructions where to send it, read it, send it there.

A waiver request for multiple filings is a simple paragraph written by you that you want to withdraw your petition for ____ dated, case number.

(get the ex' name, DOB, case number in there) Then add a reason why your relationship fell apart and that you are filing the new petition for

___, NOA1 #______ (include copies). Your confidence that this time the relationship will work because _____.

They read it, they grant it, end of story, this is your 1 minute thing. They will not notify you that it was accepted/withdrawn, they proceed with

your current petition.

As soon as you send the RFE to the designated USCIS address, your current petition to your new guy will continue to process.

NVC doesn't need to be contacted, you can if you want to. For heavens sake don't send the RFE to the NVC ! Don't confuse them by accidentally

canceling your current new petition.

I would not worry about contacting the previous embassy in Mexico. Only USCIS can close the old petition, the CO at your new embassy

will see in your case file that the old petition was canceled by you with your multiple filing waiver request.

You are overthinking the whole RFE / waiver request.

Then with the new embassy and the interview the scrutiny begins again by you and your fiance having the burden of proof that you aren't making

another mistake and know that this time it will work with a boatload full of evidence to back it up.
Be there for the interview or he just may get denied, K1's are the pits to go through in Ghana. You real fight begins at the interview, getting

a satisfactory approval for the RFE is the easy part.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
