CR1 with child (consent timing)

Hi,

In the next week or so, I'm filing CR1s for my wife and her child. She doesn't (yet) have consent from her ex to leave her country with her child. Does anyone know if this consent needs to be sent in with the initial application or provided at the interview? I'm asking because we may need to remove his rights if he won't just sign. He happens to be in jail for another 3-4 years, so she will have the ability to do this. I don't want to delay the application iff it can be submitted now without the consent.

Consent is needed at interview. She doesn't need to remove his rights. Generally sole custody is enough for most countries.

At the interview. You will have to file separately for your stepchild.

In some countries the father lose all rights if they are in jail or were not married and the child is with the mom. Let her find out about her country. S separate I130 is needed for the child to immigrant. If she needs a consent letter she will take it to the interview. Go ahead and file you have a wait to wait. Good Luck
