Question about K1 VISA! Fiancee in the states

Hi everyone! I am from Peru, my fiance is a US citizen and we are trying to complete the requirements for the I 129 F packet.

I am currently in the US visiting my fiance for the holidays on a B2 visitor visa i applied for 5 years ago (even before i met him ) and i will return to Peru in 2 weeks. We want to send the application before i leave but i don't know if the Second part "Questions about your fiancee"-Questions 15a, 15b,15c,15d...must be completed, since i am here in the US...or Would it be better if we send the packet after i leave so that we don't have to complete those questions...especially because question 15b asks about my I 94 arrival/departure number related to my last entry (which is Nov 11/2015), however...when i go to the US Customs and border protection web site..it only shows the I 94 number of my entry on Aug 15/2015!!

On the other side...is it necessary to send my birth certificate (beneficiary) and affidavits from family? We have been together for 2 years and have met each other 10 times in Mexico, Peru and the US...we are gonna send copies of boarding passes, receipts, hotels, trains, buses...around 15 pictures, skype calls history, emails, letters. We don't have the engagement ring yet but i hopefully this will be enough!

I hope anyone can help me with my questions!

Your choice. You can only place the I-94 numbers that you have access to. By the time they get to your petition (many months from now) everything should have cleared in the system.

No, the first is only needed at the interview and the latter is secondary evidence and not a requirement.

We have been together for 2 years and have met each other 10 times in Mexico, Peru and the US...we are gonna send copies of boarding passes, receipts, hotels, trains, buses...around 15 pictures, skype calls history, emails, letters.

Not needed, only the signed Letters of Intent to Marry are required.

We could marry in Peru, the problem is my fiance has been there 4 times and got really sick there with fever, diarrhea, vomiting...He is fine the first days but after that it becomes a nightmare. Even though i am a nurse and i was very careful with food and drinks he had, we were rushed to the ER three times. That's the main reason why we want to get married in the US, plus, i have family here so they can also be at the ceremony. We want to enjoy it and not worry about upset stomachs haha :)

why not marry and return home and do the CR 1

with the problems now over K1 I wouldn't even try one

We sent our K1 petition in May last year, when I was here on B1/2 visa. We sent it 3 weeks before I left for my home country and had no problems, no rfe's and we were approved 5 months later. Good luck!

This is the third scare-monger type comment you've left newbie K1 applicants about this issue. While it is important to keep this issue on the radar screen, it is a great disservice to people to continue leaving comments like this. Please know that nothing has changed yet, things may not change at all but if they do, whatever happens to K1s will more than likely happen to CR1s as well. People with bad intentions can just as easily marry abroad and come in that way, and so *overall* security screenings may get tougher, or there must be a minimum amount of overall facetime spent together etc. It is better TO apply for the K1 now because if they do change or cancel the program (cancellation is never going to happen for a wide variety of reasons), those who have applied before the change will still be processed.

23 Jan 2016: Wedding!

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. (L)

16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

27 Apr 2016: Electronic NOA1 for all 3 :dancing:

29 Jul 2016: Online service request for late EAD (Day 104)

04 Aug 2016: RFE for Green Card (requested medicals/ vaccination record. They already have it). :ranting:
05 Aug 2016: EAD/AP Combo Card arrived! (Day 111)
08 Aug 2016: Congressional constituent request to get guidance on the RFE. Hoping they see they have the form and approve!

K-1 Visa Timeline:

This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

14 Feb 2015: Mailed I-129f to Dallas Lockbox. (L) (Most expensive Valentine's card I've ever sent!)

19 Feb 2015: NOA1 Notice Date

17 Aug 2015: Sent to NVC

?? Aug 2015: Arrived at NVC

21 Sep 2015: Packet 3 complete, my boss puts a temporary moratorium on all time off due to work emergency :clock:

02 Oct 2015: Work emergency clears up, interview scheduled (soonest available was 5 business days away--Columbus Day was in there)

13 Oct 2015: Interview

13 Oct 2015: VISA APPROVED :thumbs: (236 days from NOA1)

19 Oct 2015: Visa-in-hand

24 Oct 2015: POE !

15 Dec 2015: Fiance's mother's B-2 visa interview: APPROVED! So happy she will be at the wedding! :thumbs:

Mail when you leave. Less question and less room for misunderstanding.

Thats what we did too. when we prepared the packet I was still in the US on my J-1, a few weeks before going back to my country. My now-husband waited with finishing them all the way until I left, then signed everything when I was gone already and sent it off a few days later.

We wanted to avoid there being any issues what with me being in and out of the country a gazillion times on various visas/VWP etc. And it was fine.

Got stuck in TSC which took forever, but with everything going to CSC since March - and for the time being - it should move fairly quickly.

My fiancé has his visa and is sitting right next to me. I work for Congress. I know how this works. It is not already harder (generally, certainly regions maybe but we have no evidence of that yet). You are giving bad information to people, and I think intentionally trying to scare them. This is not accurate or nice.
