Hi,

I am Alex, I am from Sydney, Australia and I have been in the USA for the past 5 years on an F1 Visa, I recently got married to a US citizen and I am in the process of filing all the paperwork that goes along with adjusting my status to permanent resident.

I have a few questions about filling out the forms and evidence needed, any help at all is greatly appreciated.

1) Has anyone got any experience going from an F1 to Permanent res? How long did it roughly take for each section to get approved? The i-130, then the EAD, Travel Doc, and I-485?

2) When filling out the the i-130 it asks my husband when and how long we have lived at the same residence, with a start and end date option. We are married and clearly still live together, would you advise leaving the end date blank or just write the date your submitting the paperwork as the "end date"

3) How many bio-metrics forms do you need to include? I know we need one for my Husband and I for the application for an alien relative, and one for myself for the 1-485 but do I need to include another somewhere else for either one of us like with the affidavit of support?

5) Because I am already in the USA and in status still I can send all the forms to the same address in Chicago, did you guys separate all the documentation for each form by paper clips, folders, etc to keep stuff together or did you just put it in one big pile in the order of the content page.

I know I asked a lot, I am planning on filing within the week as soon as I do my medical so I am just trying to make sure I have everything 100% right.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

1) The EAD/AP is received in about 80 days. The AOS processing time varies a lot by office, but for us was interview (and approval) in about 90 days.

2) Just write "present"

3) You mean G-325A? The I-130 instructions require, for spouse petitions, a G-325A each for the petitioner and beneficiary. The I-485 instructions require a G-325A for the beneficiary. So a total of 3.

5) It's not relevant whether you're in status. You mail all the forms together. People suggest using Acco fasteners to group each form's materials.

I have one more question you may know the answer to regarding the I-485 "Police Clearance" section in initial evidence, the form states to check the supplemental instructions (which I did) to see if I needed to get one. I couldn't find any extra info on this in the supplemental instructions so to be safe I went to the local PD (In the area I've lived for the past five years) and asked them to write a letter stating they had no contact with me/I had no record etc. Do you know anymore about this and if this is what USCIS wants?

You are not filing AOS as the member of a special class. You don't need this.
