Please I need an honest advice. My husband petitioned I-130 for me April 2012, the petition was approved in no time because he is an active military member. I went for my interview October 30, 2012. My husband has been previously married twice; he did the 1st divorce back in his home country Nigeria before relocating to US. His 2nd marriage divorce was in done in the US where he met his ex wife and he was able to petition I-130 for his 2nd wife without including his 1st marriage divorce papers and USCIS did not detect or request for it. When he filed for me, he only included the 2nd divorce papers. So during my interview in london embassy, the consular requested that I should present my husband’s 1st marriage certificate with my passport. I resubmitted both documents, and I was held on administrative processing for 9months. They later on realized the 1st marriage certificate was a fake one. So my petition was sent back to the USCIS and revoked October 2013, they wrote my husband a letter that they detected fraud and he does not have the right to marry and file for me since the 1st divorce finals was counterfeit.

Now, my husband has just been able to finalize the first divorce in the US. Please I need an advice to know what type of petition he can file for me. We are actually considering K1, because our marriage certificate has been regarded null and void because of the 1st divorce that was not done properly. So we intend to have another wedding immediately I get to the US. Or should we do redo another wedding again and file I-130 again. We already have a son together and we are happy together, i have relocated from london back to my home country Nigeria. Please advice me.

Your case needs legal advise, contact a lawyer. Your husband has been married three times, and two of the marriages were illegal, as he had never divorced the 1st wife. Also. USCIS has flagged it a fraud case.
