Passport in maiden name

Hello everyone!

I would like to ask if its ok my husband will file me CR1 visa even if my passport still in my maiden name? But all of my valid Id's are already changed into my husband's surname. Is it ok?or it will create a big problem in filling and more question in the embassy or immigration?

We are planning also to apply for our daughter CRBA and passport, When she will be approve thus my husband still need to apply her visa?

Passport in maiden name means visa will be in passport name and green card in visa name. So your greencard etc will be in maiden name.

It's not a problem but it costs $450 to change the green card.

Are you asking if it's ok for your husband to file the I-130 petition even though you haven't changed the name in your passport, then that's fine. Your passport has nothing to do with the I-130, unless you're using it as bona fida proof.

Once you hit NVC and fill out the DS-260 and send in your supporting documents, that's when you submit a copy of your passport and give your passport number. The USCIS phase is about five months, I think you guys from the Philippines still get auto-expedited so maybe two months for you. That means you should have at least two months till you hit NVC and another month or two there before you want to submit your DS-260 etc. That should give you enough time to change your passport to your new, married name and save those extra money it costs to change it once your green card has already been issued.
