permanent residency--- @ 2 year period??

Question?? I need an actual official answer?? We are coming up on wifes 2 year here anniversary. What im curious about is this--- She tells me she has a 2 year window -since her "Green card" was issued date-to then apply for permanent resident. I believe that period is from the date she actually landed in the usa !! Which is correct?? Landing in usa is earlier than the green card date! She also tells me she has a 90 day window to file? what form? costs? Thanx,matt

Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

It's the green card issue date that matters. She can file 90 days prior to her green card expires.

It sounds like you and your wife are talking about Removal of Conditions on Permanent Residency (ROC). There is lots of great info in the Guides, and the USCIS ROC website. There is a 90 day petition filing window read about the details in the provided links, costs are also discussed.

2 years from the green card date of issue. I am also filling mine really soon.

1. There's an expiry date on her green card. You've actually seen it, right? You can even google I-751 filing date to find out the earliest you can file!

2. You can file UP TO 90 days before it expires, along with a LOT of evidence to show that it is a bonafide marriage

3. Filing fees total $590 (including biometrics)

To be clear, with a green card she is already an LPR (Legal Permanent Resident). She is filing to Remove CONDITIONS on her residency aka "prove again that your marriage isnt a sham"

Count backwards 90 days from the expiration date on her 2-year card. Get your paperwork ready (I-751 form).

Look through this site for a lot of example lists of the evidences you need to include with that form. Put a cover page on the whole shebang and send it in with your check. Good luck!

The green card will reflect the two years since the day she became a permanent resident. When a person becomes a permanent resident depends on how they obtained it. If they did Consular Processing and received an immigrant visa, then when the person uses that visa to enter the US, at that moment the person becomes a permanent resident. If they did Adjustment of Status (which is her case since she came on K-1), the person becomes a permanent resident when the Adjustment of Status gets approved.

Have you received the letter from USCIS mentioning the removal of conditions process that everyone here has explained? It should arrive about four months before the expiration date on her greencard. This letter has important information on the process.

After that gueling affair during our AOS, was told since we were not married quite two years yet, would only issue my girls a two year card. Almost fell off my chair and I heard this. Certainly you had an AOS stage, didn't your interviewer tell you this?

Asked what then, our interviewer told me we had to fill out an I-751 form, I wrote that down, was also told my wife could apply for US citizenship in three years with that N-400 application.

Very next day, downloaded those two forms with more emphasis on the I-751, won't repeat my language, but read about the evidence requirements. And the consequences if you don't. Also looked over the N-400, same evidence again, but this time wanted us to keep track of all of our trips. So typed those in when we came back. And put a note on our refrigerator door when that I-751 had to be sent in.

So for the next 640 days, was collecting evidence, off and an on. This is the stuff in my life was history and would just pitch it, this sure changed, had to be filed.

Really would hate to be in your shoes to even try to remember what happened in the last two-three years to gather all this information. In our case, a stack of evidence about an inch thick. Not only does that two year card expire, but so does that one year extension notice, they don't warn you, up to you to keep track of all this stuff. We had to apply for an infopass appointment that was rough to get an I-551 stamp in her current valid foreign passport. Its strictly up to us to keep ourselves legal.

While my wife was working in patient assistance at our hospital, she was interviewing the patients and filling out all those forms for them. The USCIS doesn't even do this! And while I feel I am very good at the English language and did recognized all the words on this forms, the way they were put together didn't make a bit a sense, so need help from my immigration attorney to properly fill them out. Ha, he said if they used proper English, he wouldn't have a job. If you miss one N/A on these forms, can be rejected, do not pass go, lose your fee, and start all over again.
