B/2 visa for my wife

So monday my wife has her interview for her b/2 visa.she currently lives in the ukraine. Little nervous but trying to stay positive. She was given her j/1 and thats how we met so i guess i just want to know because she was given a visa already and had no problems with leaving, will it be plausable to say her chances are ok to good to get travel visa. she is in her last semester of school,and her whole family is there except me. She wants to finish school, so she has to go back and then after she goes back we are gonna file for her green card. any advice on what she should say to the interviewer, to convice them that she does in fact hope to return and that we want to wait so she can file correctly. she only wants to stay for about a month and some days, we will be visiting new york when she comes then go back to texas.

big questions: (1) why could she not just finish school in the US? (2) Or, finish school in Ukraine, then use the B2 to camp out and do an AOS? Why is visiting now so important?

I cannot tell how many times I saw people claim the same the thing about 'having to return to school' and never did. Personally, I rarely bought that excuse, unless they were studying medicine or astrophysics....something really really serious.

True, she did return from the J1, which is a plus.

True, she did return from the J1, which is a plus.

She is studying economic which i think is serious and because her family is there and its paid for by government and in us she will have not as much financial help. I think thats good reason right?

Also we have means only to do cr-1 since aos is so expensive

And she wants to live in eurooe

AOS would be cheaper than a CR1.

If you are going to be living in Europe why are you filing for a CR1?

HFM is giving you some baaaad advice when it comes to getting a B2, then staying here for an AoS. I don't think she will have any issues getting a B2 as long as she has significant ties that will cause her to want to go back to Ukraine. With her going to school there, I think that will help a lot. On the flip side, with Ukraine having a lot of issues, I'm not sure if her going to school will be enough. If she has a job and been at the job for some time, then that'd definitely look good, as well.

FYI - If she gets approved, comes here and then you file for an AoS and the IO finds out that this was your intent, then you'll most likely be denied AoS. Annnnnnd that's not good.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
