What if our RFE isn't enough? Automatic denial?

Hello,

We sent in wedding pictures, travel for honeymoon arrangements etc and such for our removing of conditions. I naively thought that'd be enough.

For RFE, we've sent in:

Our joint tax return for 2013 and 2014 (Transcripts from IRS)

Turbotax summary (printed from online)

A statement of our joint savings account that was opened in 2013 (Signed by our Bank person)

Our occupancy on our lease and that we're in good standing with our landlord (Signed by our Landlord)

Me being beneficiary on Husband's health insurance (printed from online)

Me being beneficiary on Husband's retirement plan (printed from online)

What if this isn't enough? We don't have anything more, we're young, don't want kids and live in new york so no house or car together.

If it isn't enough, will the automatically deny us? What happens to me then, do I get kicked out? Is that even legal since we haven't committed a crime, we just don't conform to the BS conservative american "have children as soon as you're married!!!" way?

March 2008 - Met my husband (US Citizen)

10/10/2012 - Arrived to the US on M-1 Visa

01/13/2013 - Husband arrives to the US

03/15/2013 - Got married in NYC City Hall!Received marriage license on the same day.

03/30/2013 (Day 0) - Sent in I-130, I-485, I-765 and I-131

04/03/2013 (Day 4) - Package received in Chicago

04/10/2013 (Day 11) - NOA 1 text(s) and emails received.

04/15/2013 (Day 16) - Biometrics appointment letter for the 7th of May 2013.

04/22/2013 (Day 23) - Successful Biometrics walkin Varick Street, NY

04/30/2013 (Day 31) - I-485 case status updated to testing and interviewing. Still no updates on EAD or AP

05/07/2013 (Day 38) - Biometrics appointment

06/07/2013 (Day 69) - EAD updated to Card production. AP updated to Post Decision Activity.

06/15/2013 (Day 77) Recieved EAD/AP combo card

07/10/2013 (Day 102) Received first interview appointment
08/10/2013 (Day 132) Interview (which we rescheduled because I was out of the country at the time of the interview)

08/24/2013 (Day 146) Notification that our interview has been successfully rescheduled

11/25/2013 (Day 239) New Interview date: 16th of December 2013

12/16/2013 (Day 260) INTERVIEW! - Approved on the spot, will have green card within a few months

Don't worry-You are creating scenarios in your head that will not happen!

Even if they feel that all you present is not sufficient, the worse that could happen is that you will have an interview.

At the interview you will have the chance to give them more elements about your relationship. As it is a real marriage you will not

have problems. Don't worry - there are many unconventional marriages, they are trained they will understand.

Ah, ok. Interview sounds good. I was worried it was automatic denial if evidence wasn't enough.

If you're interviewed, you'd better bring the entire "kitchen sink" of evidence. Don't treat it casually.

Property or not, create Wills, Medical Powers of Attorney, and similar documents now. These are excellent evidence for ROC and are even more valuable to have in "life."

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

What about Con Edison bills? Gas? Internet? Cellphone family plan? You could add all of that to your package if you are called for an interview. But I think you should be fine and will get approved soon! You just sent too little stuff on the first place..

Agree with T-Bone. :thumbs:

Right now it seems that USCIS adjudicators are fixated on "all marriage bonafides since the inception of the marriage." As many of us know, a lot of that "marriage bonafides" stuff is just that, stuff. Stuff, window-dressing that has been conjured up by some USCIS bureaucrat that serves as a "true indicator of a real marriage" (in their eyes). But if that is what they want, my feeling about our recent RFE response was, give 'em everything 'cept the kitchen sink. (Save the kitchen sink for the interview...lol). We sent them a paper copy of anything and everything that we had accumulated, joint or marital, since the marriage inception. I had initially sent in quarterly financial statements, with the RFE I sent in everything that we had, from anyone that we had done business with since the inception of the marriage. Finally, my wife and I had our wills, DPOAs, Living Wills prepared. We included copies of them in our RFE response. Don't hold back anything, send it in.

WE were so 'done' with the process after 8-9 months in limbo that in our RFE cover letter, we said, to the effect, either approve our petition, or give us an interview; but let's get on with it! It is time for our family to get on with our lives, and start living our American dream.

Have kids as soon as your married is the norm in the US? Hmmm.... Having a kid shows that you spent a few minutes together.

It's not proving that ceremony took place. That doesn't show a true, honest attempt at living as spouses. It's just a party.

The comingling of finances is one of the best types of evidence to show. Joint accounts and memberships, joint ownership of property, cars, investments, naming each other as beneficiaries of wills and life insurance, etc. Showing a common address on bank statements, utility bills, car registrations, driving license, etc. A good sample of those items along with some travel photos, travel receipts, and other average things that couples/families do. That usually satisfies the adjudicators when removing conditions.
