You should apply as soon as possible because you're currently out of status. It's fine to apply after your visa has expired.

truth is, you could face some challenges with immigration because you came in as a visitor and not to get married...uscis will see this as that u played smart by using a b1 to obtain permanent residency..others have done this and gone through with it but uscis has become more tough on this but all the same u can try...just be ready to explain why u overstayed and got married

Completely wrong.

USCIS can not deny the AOS of an Immediate Relative of a USC for preconceived intent. Read Matter of Batista and Matter of Cavazos.
