What would you chose?

Hi everyone,

We are currently trying to figure out which visa would work best for us. We are not yet married (my SO is a US citizen) but we are planning to. However, we ideally would go the route of the more affordable visa process to have more money for our future. I am currently in the US, if that plays a role. Can you help us out? What would you do?

Best wishes, happiestoflives

Since you're in the US, if you get married, you have the option of adjusting your status and staying in the US which would cost about $1490.

As a fiancee, going the K-1 route would cost about $1650.

And if you were to get married and do the CR1 route, where you'd interview in your home country, it would cost about $900.

Here's a comparison chart: http://www.visajourney.com/content/compare

If you'd like to keep the time away from your SO short, then it would be best to do the adjustment of status since you're already here. Would you be able to clarify under what visa category you're in the US?

Yep! You'd have to go with the CR1 route if you were to go home. The processing time is about 1 year for this visa.

Here's the CR1/IR1 guide: http://www.visajourney.com/content/i130guide1

so you can see what type of documents you'll need

It might be worth noting also that cost is not only the money paid during the process. In some of these paths, there is a period of time where the intending immigrant is unable to work.

2012: Married
2014 2016 2017: I-130 packet direct to Frankfurt

Frankfurt's "steps" to DCF:

Step 1: I-130 Petition Checklist (PDF, from their USCIS page)

Step 2: Immigrant/Fiance(e) & K-Visa Applicant Checklist (PDF, from their Appointment & Interview page)

Absolutely agree with you. Before replying such a question we must know about your current status of living in USA.

What exactly is your point, considering that I already replied to the question asking what my current status is?!

Thank you, teeak!

So if I had to take care of a few things, CR1 would be the better choice?

With the CR-1, you will want to factor in other expenses - like plane tickets. You will also be separated for a year during the immigration process.

IMHO - the best route is to marry and adjust. You can get an EAD within 90 days and be able to legally work. With the EAD, you can get AP to travel internationally and be able to return to the US.
