EAD name spelled wrong

Hi everyone

I got an update on my EAD yesterday saying they mailed my card, today I got the approval notice in the mail and, of course, my first name is spelled wrong.

I changed the spelling error on their website months ago...

Has anyone had this problem?

I read I have to send the card back and fill out a new application. Does anyone know how long it's gonna take to get a replacement? Another 3 months or is this faster?

Happens every once in awhile, hence they have those instructions on the paper the card was attached to. Should be faster, but who knows for sure....?

After filing the second I-765 and receiving the NOA receipt you can seek an expedite of it under the criteria of a USCIS error.

Do I have to submit all the supporting documents too or just the form for i765?

Submit everything, including the EAD with the error on it, and probably a covering letter stating the problem with it, too.

The information on the EAD instructions are very confusing. But I just found this:

"If the card issued to you contains incorrect information that is attributed to a USCIS error, a new Form I-765 and filing fee are not required. Instead, you must submit a letter, accompanied by the card containing the error to the Service Center or National Benefit Center that approved your last employment authorization request."

So I guess all I need is the card and a letter saying what's wrong with it?

Do I have to prove that the error was cause by USCIS?

I'm gonna call them tomorrow... I was just hoping anyone had the same problem and could tell me what to do because I don't trust what they tell me on the phone. It happened a few times that they didn't advise me correctly on the phone..

I sit corrected. It's in the I-765 instructions, you are absolutely right.

USCIS will not be open tomorrow (Columbus Day - federal holiday).

Do you have a copy of the I-765 you submitted to USCIS showing that you gave them the correct name and so the mistake was theirs?

I talked to a tier 2 officer today and she said my name is wrong in their system, even though she was able to see that I did correct it a few months back.

So now I'm gonna get the card with my name spelled wrong, I will have to send it back and explain the error. Possibly another 2 - 3 months until I have a replacement.

This is ridiculous. I have already been waiting 4 months.

Just wanted to update everyone on my EAD process, just in case someone has the same problem.

I sent back my EAD with the wrong name, along with a letter explaining the error, and evidence that it was not my fault. In the letter I specifically asked them to expedite the new card, mentioning again that the error was caused by USCIS, and also copying the text from their website that states that it can be expedited if its a USCIS error.

I got my new card after 4 weeks, which is way faster than I'd expected. In fact, I now have the new EAD and am still waiting for my SSN. But that's another issue.

Anyways, everyone who has that problem, make sure you explain what the problem is, how it should be fixed and that you want it expedited. Otherwise it can takes months, at least that's what I was told at my InfoPass appointment.
