Hi,

I have received in the mail that my petition was approved on October 2nd. It says that the USCIS has done their part and they sent it to the NVC. I got some question. What do I do now? When do I fill out the affidavit of support and how do I do it? I am currently unemployed living with both my parents. Do I need a joint sponsor with one of them or how does it work? When I fill out the affidavit of support, who do I send it to ? Is there any other documents that need to be filled out? Thank you.

First, do NOT wait for the NVC to contact you. I've rarely seen anyone contacted by the NVC for a K1 visa. You need to start calling them about two weeks after your NOA2 (the approval) to get your case number. That way you can track it on ceac.gov to see when it gets to the embassy, and follow the rest of the process until the visa is issued.

As for the Affidavit of Support, wait a little longer to send it...I would wait until she gets her checklist to send it. You will need a joint sponsor that meets the poverty guidelines for his / her household size. Even though you are the primary sponsor, both you and the joint sponsor have to fill out the form.

It's always great help to anyone trying to help you if you have your country selected in your profile and your timeline up to date.

Good luck!

Hi,

Thanks for the information. I have updated my timeline and my country from where my fiancee is from. My father will be my joint sponsor so he and I have filled out the form I-134. My question is about the annual income he makes. He is self employed as a truck drier but he did his taxes with my mother since they are married. Do I use Line 22 which is both their incomes combined or do I use a different line.

Also should I start calling the NVC this week or wait until next week?

Also is it common I got my NOA2 22 days after my first?, seems I got lucky since the average was 3-5 months. I was surprised and very happy to see it was approved so fast.

Thanks.

Thanks.

First, you were very lucky to get 22 days from your first to second! Congrats and feel blessed haha!

Start calling the NVC around 2 weeks after you got your NOA2. It is hard to get in touch with them because of how long they put you on hold. Call at 7AM Eastern Standard Time. Like, right at 7:00, not 7:01 haha, this will increase your chances greatly of getting in touch with them. When you talk to someone, they will ask you for some info (your name and birthday and your fiancee's name and birthday) and something else, I'm not sure.

If they have your case number, they will tell you. If they don't, they will say something like "Please wait 35 days from the date of your NOA2 for us to process everything.) This isn't really true. They tell everyone that, but they will most likely get it much earlier. Just be persistent and call right at 7AM EST on the dot.

As far as the joint sponsor question, you can only have one. Even if he files taxes jointly with your mother (which isn't a problem) you CANNOT factor in your mother's income as that would technically mean you are using two joint sponsors.

In my case, my mother was my fiancee's joint sponsor. She files taxes jointly with my father, but the tax returns and W2's show what each one makes, so that is not an issue. Just make sure that your father meets the poverty guidelines on his own (NOT factoring in your mother's income) regardless of whether they file taxes jointly or not.

I hope this helped, and sorry for the late response, things have been crazy lately haha.

Best of luck!

Thank you for the information!

I'm still a little confused which line to use from the tax returns as my father annual income for the I-134 form.

The individual income tax return has both my father and mothers income on line 22. On line 7 which are wages salaries, tips, which I assume is my mothers and on line 12 its the business income which I assume is my father. So I should use line 12?

My father is self employed as a truck driver so he has the Schedule C form 1040, which has gross income on line 7, maybe I use that one?

Thanks,

I'm not sure about that. Honestly, because I've never filed jointly, I don't understand the details of tax return forms. My mother knew what to do when filling her's out. Maybe you could ask your mother or father to see which is which?

Thanks for you help!

I am still waiting on my case number from the NVC, I called and they told me they haven't got it yet and to wait at least 30 days. But I have a couple of questions.

1. About the tax returns from my father. Do I just need tax returns+W2 from 2014 or do I need from the past 3 years, 2013 and 2012 as well?

2. I know i need to include pay stubs, Certificate of Work Employment, and bank statements, anything else needed like my fathers passport or anything?

3. I didn't file taxes for 2014 as I was unemployed but I did file for 2013, should I include that tax return for my self?

Thanks for the help and sorry for all the questions :P
