applying for a Greencard when you are in the US on a tourist visa and your case is not being reviewed ?

What are the options of applying for a Greencard when you are in the US on a tourist visa, your sent your IV package months ago and are still waiting, and you don't wanna go back to your country without an interview date?

I have a scan date of july 6 and I have been waiting ever since for a case review. It's also a checklist; we forgot one little question on the i-864 (part 3 item 7, total number of immigrants) :bonk: :bonk: :bonk: on both the sponsor and joint sponsor's i-864.

That's the only reason we received a checklist...

I flew back to the US with my husband on september 15, I am hoping that my case will be reviewed soon and that I will come back to Paris for my interview and medical, then fly back and finally be able to start working here.

Both NJ senators offices already contacted the NVC for us, the NVC said the "case is under review" and I don't see any criteria I can send an expedite for, except maybe "

  • Mistake or error on the part of the USCIS;"

If the 3 months of my tourist visa are almost up and my case is still not moving, what can I do ?

Timeline

Since you've already started the consular processing, it wouldn't make sense to stay and adjust. I would recommend calling NVC and talking to a supervisor. That's what I ended up doing since our case was stuck since July. It took me two chats with a supervisor to finally have it completed the day of the 2nd chat.

Thank you; I've been calling the NVC almost every day and was able to talk to a supervisor only twice in august.

The last one I talked to put the case on "document review department" in august 25

Yes, that's what happened the first time I talked to a supervisor! She said she would send a message to the document review department. I waited for almost a month and saw nothing happened so I called again. I ended up talking to the same supervisor who realized that I've been waiting for an unnecessarily long time. She then ended up sending a message to all the supervisors in the DR department to review my case and I received the CC the same day.

the first supervisor I had on the phone is Sylvia, the second one I had, Lyvia, who put me on document review department, apparently doesn't work there anymore.

Anyway I'm on the phone right now, I'm gonna try to speak to a supervisor again but they always tell me no one is available.

Yeah, I can definitely relate. I hear Sylvia is supposedly really good and reviews things on the spot. The supervisor I spoke to was named Nadi. Every time they tell me there's no supervisor available, I tell them to put me back in the queue so I can ask the next rep who picks up.

got a very mean operator who told me that everybody's waiting for 3 months, don't compare to other cases and I need to wait; no supervisor is available ... calling again

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You're in the same boat as us. Scan date on our checklist is June 29th and we've been on supervisor review since June 25th, so I feel your pain. NVC flipping sucks if you get the wrong person reviewing your case! :ranting:

Was that the answer NVC gave the Senators, that your case is under review? If you get stuck like you and I have, it seems sooooooooooooooo difficult to get moving. It's like being stuck in the mud and you just cannot pull your foot out, no matter what you do. :(

You're so far in the process though, doing AOS will mean a lot more forms and more waiting and more fees. Hopefully you'll hear some good news before your 90 days are up. Hoping we'll both get good news soon and can leave our NVC hell.

oh no ! I didn't know you were still there too. Do you try reaching a supervisor ? I tried calling again today but their office is closed for Columbus day

I resent my documents on september 24 because I think the first documents I sent were never entered into their system, even though the operators always told me the documents had been received.

The two senators offices of New Jersey got a quite different answer from the NVC:

Around september 22; senator Menendez's office was told "the NVC is still waiting for the documents. "

Every operator I talked to, told me to ignore the email Menendez had received, the NVC has my documents, Menendez received a computer generated answer; blablabla

I sent my documents again anyway; and got a september 24 new scan date

On september 30, senator Booker's office forwarded me that the NVC had received my documents and were reviewing my case.

...

We are going to see a lawyer next week. I know paying more fees is annoying; but not working is making me loose more money
