Petitioner Losing Job after IV interview date is Scheduled

Hi I would like some advice on this. My husband's interview is scheduled for next month and I recently lost my job. Do you think this will be an issue when he goes in for his interview, or is it a case that once the case is complete at the NVC they are going with what is already locked in?

I should be back in a job before the interview, but I was wondering if there is any way they would know about it in the event I do not obtain another job before then.

Will the fact that I filed unemployment for a short period affect his interview outcome?

Yes, it will be an issue. If information on the I-864 that was previously submitted has fundamentally changed, then an updated one needs to be brought to the interview, failure to do so is Material Misrepresentation which will have serious consequences for you and your husband.

If you cannot find another job before the interview takes place, then you will need either or joint sponsor or sufficient assets to satisfy requirements.

So do I need to fill have an updated AOF filled out for him to take with him?

Won't that delay the process longer when he goes in to interview, as in wont they turn him back until they have had an opportunity to process the updated AOS?

How would it be material misrepresentation when they documents were filed long months before I lost my job? Lol are they trying to say once you file for your spouse you are not allowed to progress to another job?

Also doesnt the AOS have to match up with your TAX return paperwork? I mean we were check listed for a short moment because 1 digit was different from what was on my tax return. So how would we update AOS with new job deets if there is no Tax return to go with it?

Also the KEY WORD is case has been completed at NVC so the AOS has been long submitted and sent off to the Embassy. Just wanted to clarify just in case you were thinking along the line of the case still being under review at the NVC.

If you'll be back in a job before the interview, complete an updated I-864 with your current income. Provide pay stubs from the job, employment letter etc. If not, look into getting a joint sponsor. Its material misrepresentation because you're not informing CO of the change and knowingly giving them the impression that you still hold the same job as represented in the I-864. Once you file, of course you can change jobs but what's key is informing them of the change.

They won't turn him back because the CO will review the I-864 at the interview. It shouldn't be a problem if the new job you have is enough to support your spouse. The tax returns are from previous years and they request it just so they can see that you have the capability of earning an income/stable job. What they mostly like to see is that you have an ongoing current income which will support the spouse once they immigrate.

No, I was not thinking along the lines of your case still being under review at the NVC, your initial post was clear as to what your case status is. The fact that it has been completed at the NVC is irrelevant.
