Hello

Well one of my friend got robbed his phone and money by a thief with a gun, also the thief told him that he would kill my friend if he got the police.

Someone told me that if my friend goes to the police he can also ask for a kinda special green card but we find that kinda ahrd to believe.. my friend didnt go to the police because his visa is expired for like a month and he is scare about getting deported.

does anyone knows about it?

Thank you!

There's not any kind of special green card given to someone on account of being a victim of crime. That's silly.

He's not going to immigration authorities to report the crime, he's going to the police department. They're going to take the report and look for the criminal. For him to not report the crime out of fear he'll be deported is also silly.

When did this crime take place?

I guess is for like to help the police to get criminals.. and it was like 2 weeks ago

2 WEEKS ago?! Oh boy! I wonder how he would prove he was robbed 2 weeks after the fact. He's going to have to have solid proof he was a victim of crime. You'd be astonished by how many people report themselves to be victims of crimes that didn't happen.

You mean a U nonimmigrant visa....which is temporary.

My nose may be misleading me, but I smell something fishy here.

U is very popular mainly with those here illegally, I remember reading about one case where the incident was 7 years prior so 2 weeks is nothing.

Can certainly eventually lead to US Citizenship.

I have been surprised about some of the cases I have seen that have been approved, now obviously you need police cooperation but there is quite an industry out there.

I seem to remember it is particularly easy to get Police cooperation in CA.

He should report the crime regardless, was his wallet taken

he needs to give a full report & get a copy, then go to his

local legal aid or catholic charities office an apply for a

U visa, they will help him obtain the I 918B certification

from the precinct reported to...no he's not gonna be deported

The U visa is given when the court system wants someone that doesn't have a status in the US to hang around to be part of their case against someone else. For a petty robbery this is not likely to happen. If it could happen immigrants would be lined up at police stations for miles report all sorts of minor crimes to extend their stay in the US. If your friend was a witness to the Boston bombings then it would be probable if they didn't have enough US resident witnesses

This will not be over quickly. You will not enjoy this.

Am I eligible for U visa status? What crimes could qualify me?

Victims of certain crimes may qualify for U visa status. These are the basic eligibility requirements - you must meet all of them:
You have suffered "substantial physical or mental abuse" as a result of being the victim of one (or more) of the following criminal activities (or similar activities) that violate federal, state, or local criminal law:
rape; torture; trafficking; incest; domestic violence; sexual assault; abusive sexual contact; prostitution; sexual exploitation; stalking; female genital mutilation; being held hostage; peonage; involuntary servitude; slave trade; kidnapping; abduction; unlawful criminal restraint; false imprisonment; blackmail; extortion; fraud in foreign labor contracting; manslaughter; murder; felonious assault; witness tampering; obstruction of justice; perjury; or attempt, conspiracy, or solicitation to commit any of the above-mentioned crimes;
You have information about the criminal activity (or if you are under 16 years old, that your parent, guardian, or “next friend” has information about the criminal activity);
You can provide a certification from a law enforcement authority that states that you have been helpful, are being helpful, or are likely to be helpful to the authorities investigating or prosecuting the criminal activity (or if you are under 16 years old, that your parent, guardian, or “next friend” has been helpful, is being helpful, or is likely to be helpful);
The criminal activity:
violated U.S. law; or
occurred in the U.S. (including Indian country and military installations) or the territories and possessions of the U.S.;* or
violated a U.S. federal law outside of the U.S. but the law allows for the criminal to be prosecuted in U.S. federal court;** and
You are not in violation of the immigration law's inadmissibility grounds or, if you are, that a waiver can be (and is) filed to ask that those violations be excused.***

Violent crimes: murder, manslaughter, vehicular homicide, robbery, felonious assault (what qualifies as felonious assault can differ, but usually involves the use of a deadly weapon, and can include statutory rape and other offenses), and domestic violence. Stalking was also added to the list of crimes for petitions filed after March 7, 2013.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

First and most your friend should report the crime, than second your friend must have some type of valid ID to be verified against that says he is who he says he is. Therefore this means a trip to his embassy to get a new passport, if he has no other ID to verify is idenity.
