Filling out DS-260 online... How shall we answer the question #41 - "Have you ever been charged, arrested or convicted of any offense or crime?" - if my husband once spent a day in the police custody after he made a car accident, having fallen asleep behind the wheel? (No casualties or injuries) His police record says - "is not convicted or on the wanted list"

CR-1 Visa

I-130 Sent : 2015-07-10 - sent from abroad, auto-expedite

I-130 NOA1 : 2015-07-14

I-130 Approved : 2015-08-13 (30 days)

Yeah, I agree. Sounds like he's been arrested. The police record just relays that he's not a convict or wanted criminal. Just answer truthfully, and explain the scenario in the box that should appear underneath the question.

He was not declared he was under arrest, we was simply kept in a cell at the police station for less than 24 hours, and then they let him go and told him he has to appear in court. Probably, we should consult a lawyer...

If you're held in a cell without being arrested then that sounds like unlawful imprisonment.

As a former Soviet republic, maybe things are done differently in Georgia.

It's not as if answering "Yes" is going to derail the application. They will simply ask for the disposition of the case, which you have already, and that will be the end of it.
