Ghanaian Husband's Visa CR1 Denied

I used a lawyer, we submitted all required documents, had lots of photos, whatsapp phone calls everyday, Western Union confirmations, and still he was denied.

What can I do? I would appreciate any help. Personally, I'm in shock about this. He was given a letter 221 (g), but it was vague, no specific reason given for his denial.

We have an age difference, I'm older, but the CO stated she believed we are a couple, no problem there, but would not tell him the reason for the denial and the paperwork does not state it.

Any one with this experience, what have you done. The letter states the case is going back to USCIS, but I don't want that to happen! Can I appeal this decision right away?

Good morning, sorry to hear your husband was denied. Was the interview conducted at the Ghana embassy or somewhere else?

It was conducted in the embassy in Accra Ghana. I cannot figure out what went wrong, we submitted all required documents.

If you can, I will suggest to maybe go to Ghana and speak with the embassy and request another interview. Of course you will have to do that asap before they return the application or you can contact your congressman for him to inquire from the embassy their reasoning for denying. That is what most people here have done in the past. Good luck.

You will not be able to appeal the decision at this time. Once the file reaches USCIS and reviewed, one of two things will happen:

  • They will reaffirm the original approval of the petition without needing anything from you and return it to the Embassy for another interview.
  • They will send you a Notice of Intent to Revoke (NOIR).

If you receive an NOIR, it will sate the specific reasons why it is being sent along with a deadline to submit a rebuttal (usually 30 days). An NOIR rebuttal must specifically address the reasons in the notice. Proper response to an NOIR does not guarantee reaffirmation and reaffirmation does not guarantee a visa will ultimately be issued.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Have you husband write down every event of the day, What was said , what the CO did, what he did. Maybe you can figure it out from that.

This will not be over quickly. You will not enjoy this.

Yes, he went over the events of the interview, and I believe it had something to do with the mother of his daughter, who he hasn't even seen in 7 years. the CO kept asking questions about her, and because my husband hasn't seen her, he had a hard time answering the questions. I believe this is the reason.

I've contacted my congressperson and am waiting for the immigration person to call me back.

So how many times have you visited your husband and for how long?

How long have you been together and been married?

You said you have a lawyer, what are they doing as far as finding out getting the transcript (yes it's possible) of the actual interview. You paid for a lawyer make them work.

Are you just in AP? I think the 221(g) is AP, which is technically a denial, really means "Not yet". A visa refusal is a "NO!!!" and involves the NOIR, as Ryan was typing about.

In my case, we are 221(g) - just in AP.

Well has he seen the child in the ;ast 7 yrs? sorry about your troubles, even-though

USCIS has rules for the adjudicators to follow they are however humans and in

high fraud countries they tend to look at the tiniest things, how is the ex he have not

seen 7 yrs is having privy to his info for migrating

He has seen his child....he raised her after the child's mother abandoned her. He has not had any contact with this woman, and she doesn't know anything about his immigrating.

We were married in May 2014. I lived in Ghana with him for 8 months. We bought a house and car together. He presented all this paperwork and more.

It's a 221 (g), but the CO wouldn't give him any reason for this paper and nothing was checked on the checklist. She just said it's being sent back to the USA, USCIS and not to contact the embassy.

I just sent everything to my congresswoman's aide, so I'm hoping this will help. It's appalling, really. I was born in this country, our marriage is real and this CO just plays with our lives.

Visas are granted and refused by the consulates, part of the Department of State. USCIS is part of the Dept. of Homeland Security.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's the issue he has a child and they don;t believe he hasn't had contact with the Mom. Were you petitioning him and the child?
