Evidence for I-129F petition, transgender beneficiary

Hi everyone!

I've been preparing all of the documents for our K-1 visa petition and I think I'm ready to send them off to my fiance in the states for him to file, but before I do that, I want to check that I have everything in order.

We've been together for over 5 years and he has been living with me for most of that, so we have amassed a reasonable amount of evidence that we are in a bone-fide relationship. It was going to be used for a residency application for him to stay permanently in NZ with me, but plans change!

The thing is though, I am transgender and only came out publicly a year ago so the photos from early in our relationship are of "the old me" and the majority of our paperwork is from before I legally changed my name. I have included a "Statement from Beneficiary regarding name change" to include in the petition, in which I state that I am transgender to (hopefully) avoid confusion.

Included in our petition package along with completed I-129F form:

  • I-129F supplement: Part 2, Question 34a, explanation of meeting in person (very brief, 2 paragraphs)
  • G-325A with passport photos for each of us (mine with previous name listed under other names of course)
  • Proof of US citizenship (my partner's birth certificate)
  • Letters of intent to marry from each of us (he'll sign his before filing)
  • Statement from Beneficiary regarding name change (and gender change)
  • Proof of Beneficiary name change (my new birth certificate - has birth name and new name on it)
  • 7x photos spanning our relationship from 2010-2015, some with family, all dated with the names of the people in them
  • Copy of my passports (old and new) bio pages and US entry stamps
  • 5 years worth of airline tickets traveling back and forth to see each other
  • 15x screencaps of Skype chat logs from random days across a few months
  • Copy of joint tenancy agreement for the rental that we lived in together in here in NZ
  • Copy of utility bill with both our names on it
  • Copy of joint bank statement showing both our names as account holders
  • Copy of life insurance policy wherein my partner gets paid out in the event that I die

Will this be sufficient? Have I forgotten anything??

Like everyone else I just want this to go as smoothly as possible so I can be with my partner. Long distance relationships are hard!!!

Fast forward past the couple of months of doubt (his) / confusion (mine) about whether I should be giving up my career for him and maybe he should be trying for residency in NZ instead... :cry:

07Mar16: Packet 3 sent with request for extension of petition

09Mar16: Medical

11Mar16: Interview letter received

31Mar16: Interview APPROVED

28Apr16: POE LAX - America here I come!!!!!

You've got a good list of items to include with your petition, it looks fine to me. I'm sure if anyone else can think of something you have overlooked, they will jump in.

Will you be interviewing in Auckland, and doing your medical there? There used to be a New Zealand forum, which got merged with Australia, and a useful thread from back then which had quite a lot of useful info on interviewing in Auckland fell off the first pages. I will hunt it out for you if that is where you are.

Thank you cdneh! Yes, I'lll be interviewing and having my medical done in Auckland (it's where I live so that part at least will be convenient). I'll do some digging around in that forum and see what I can find.

Just make sure to get everything in the "other names used " section right and you should be ok.

Great info, she was the first of our group that went through it, and it sure made it easier on the nerves of ones who followed her. Good luck!

My fiancee and I did this, with the transgender caveat and all. This was pre-Obergefell, so we also had to prove that Illinois would allow the marriage. You should fortunately get to dodge that step.

The one hitch we had is that the German embassy required me to send a letter confirming that I was aware of my fiancee's transgender status, which slowed things down by a week or two, what with international mail and the like. Eventually, everything went through, but it was an extra hoop for us to jump through.

Just make sure you have all your paperwork in order, and you put your old name in the previously used alias field, and you should be OK.

We just received our approval NOA2!!! :joy:

I submitted everything exactly as I described above, with post-it note tabs marking each section and did not receive an RFE. If any other transgender applicant/beneficiary comes across this topic in a future search, include a statement like I did regarding name change (and gender) with the rest of your evidence and it shouldn't be an issue :thumbs:

10/09/2015: Consulate acknowledged receipt via phone; Hardcopy from US DoS with case number.
10/19/2015: Received information from Consulate.
10/28/2015: Medical Exam
11/17/2015: Interview...rescheduled due to computer problems. New date as yet unknown.
11/18/2015: Called in for interview and APPROVED!

11/24/2015: Picked up visa/passport and sealed packet from the Consulate! <happy dance>

02/14/2016: Arrived in the U.S. (POE was Bermuda)...CO was really nice!

02/18/2016: Married! :)

04/26/2016: Received notification that the I-131 was approved and the name was updated on the I-765
05/23/2016: Received notice that card was being produced for I-765.
05/28/2016: Received EAD/AP card.
06/01/2016: Received electronic notice that AOS interview has been scheduled.
06/30/2016: I-485 interview at USCIS Baltimore Field Office.
09/01/2016: InfoPass appointment made for 09/07/2016.
09/06/2016: Received electronic notification that I-485 was approved on 09/02/2016.
09/09/2016: Received approval letter.
09/14/2016: Green Card delivered! :)

06/25/2018: NOA/extension letter received, dated 06/19/2018

07/14/2018: Received ASC notice for Biometrics Appointment

07/25/18: Completed Biometrics

06/13/19: Received email notification of card production. I-751 approved!
