Hi everyone

I have few questions I'm confused

My wife don't meet the requirements of poverty . She has 3 kids with her ex husband and he don't pay the support to them and also she didn't work good in last 3 years . 2012 its like 15k and 2013 she was sick she earn like 12k and 2014 like 9k cuz she visited .

In the form of i864 does she will count me as household even we have the jointsponsor and she will make it 5 . Me and her and her 3 kids . Or only her and her kids .

So we found her sister like our jointsponsor she made good like 24k per year for the last 3 years . And she has a kid whose his dad pay for him the support because she live only with her child .

The question is about the jointsponsor while while her son his dad payin for him the support . Does she will count him in the form as household . Does she will count only 2 me and her or all of 3 ne and her and her kid .

On your wife's I-864, she includes herself, her kids, and you. Her sister will include herself, her child, and you on her I-864.

02/04/2013 Received hard copy NOA1 (case not found in on-line system) 12/02/2013 ELIS site still states "accepted"
03/12/2013 Transferred to the local office 12/27/2013 received green card
04/10/2013 Case still not found in on-line system
04/15/2013 INFO-PASS appointment

05/01/2013 NOA2 sent petition approved

05/09/2013 Case received by NVC

05/23/2013 Received case #'s from NVC

05/23/2013 DS-3032 sent from husband's e-mail

06/03/2013 First day I can not access payment portal

06/04/2013 AOS Fee invoiced and payment made

06/04/2013 DS-3032 resent with Supervisor Review

06/05/2013 DS-3032 acceptance e-mail

06/05/2013 AOS Fee shows "PAID"

06/06/2013 AOS package express mailed

06/07/2013 IV bill invoiced and payment made (still waiting on documents from Hubby)

06/08/2013 IV package express mailed

06/25/2013 IV reviewed - Checklist (2 errors, Birth document & date on DS-230)

06/26/2013 Requested supervisor review by e-mail & verbal request for birth document (fingers crossed)

06/27/2013 AOS accepted

06/28/2013 Checklist response sent for corrected DS-230 (I had my husband sign extra's just in-case)

08/02/2013 NVC requested a supervisor review on the checklist item over 20 business day window

08/05/2013 Case Complete!!! kicking.gif

08/27/2013 Interview Assigned

10/30/2013 Interview

11/04/2013 Pick up Passport

11/12/2013 POE @ JFK

I don't think she has to list her ex husband in her tax and is counted as family member anymore .. Check her tax return after she got divorced

Also u may want to have an appointment for consultation with an immigration lawyer for this question

How long was she divorced ??? Is she us citizen by birth???

Timeline

Your wife will have a household of five, herself, three children, and you. The sister will have a household of two, herself and the child, plus you, the intending immigrant for a total of three. The ex husband is not counted as he is no longer part of her household. The child is counted as it lives with her.

Alright Guys thanks for your help , sorry i still didn't get the Right answer for my Question ( i'm not talking about the Husband ) so he is not in the story Just forget about it ..........So the question i'm trying to get an answer for is...If her sister receives child support does she still have to count her child in the household size?

Yes, the child is part of her household. The child lives with her. She provides support for the child. The child is counted as part of the household. Her receiving child support does not remove this.

Thank you belinda for ur relpay , so what i understand she will count him in her household means if she make 24k so it wont be enough for 3 household and the requierment of the Poverty she wont meet them
