Renewing ESTA ?

Hi

may be a silly question but bear with me :)

I have my interview on the 15th for K1, now Im hoping to be flying on the 3rd October, but my ESTA has expired. So if for some strange circumstance I fail the interview would I :

a) a still be able to fly on and ESTA

b) Can I apply for an ESTA now and not interfere with the K1 ?

Any help or thoughts appreciated

Travel authorization on the visa waiver program is separate from K1. ESTA comes from CBP/Homeland Security. The visa comes from Consulate/Dept of State.

Of course once you have a visa, then you no longer need to travel visa free so the Visa Waiver Program isn't needed. AND also , if you are denied a Visa on the 15th then you are not eligible to use VWP, even on a renewed ESTA. Your circumstances would have changed since you applied. Right?

If you get your k1 approved, then you don't need to renew your ESTA as your k1 visa will act as your admittance, but once you enter the US you will not be able to leave. You cannot choose to not use the k1 visa, meaning that once you are approved, the very next time you set foot in the US you are stuck there until AP or green card.

If you do not get your k1, and you try to enter on the ESTA, you will probably be turned around since that denial will come up.

I agree, applying fro ESTA is possible but you will be declaring a recently denied visa so approval is unlikely.

wrong, you can always leave, you just cant get back in

If you apply for Advance Parole (and get the approved AP card/ document) when you apply for AOS, you can leave and return before your green card/ LPR is approved.
