Hello friends!

I want to give a sincere thank you to everyone who helped me understand this process.

Visa Journey has been such a blessing in my life, and you all are the BEST!

We were just approved for my fiance's k1 visa to enter the U.S. He will pick up his

visa in a few days at DHL and then he will be entering the U.S. in October, so we

have some time before he comes.

What is the next step for October? Should I be filling things out now? He wants to start

working here as soon as he can to help me out, so can someone please give me

some advice? I'm completely clueless as to what comes next. I feel we've just won

a battle, and that we're about to start another with confusing paperwork.

Congrats! You have nothing else to fill out. You have to get married first before you can get him a temporary work authorization. So get married, and THEN you can file Adjustment of status (AOS) its a few different legal forms, Employment authorization, Travel document, Affidavit of support and the Adjusment of status of course. All in one you send in all those forms. It will cost you 1070$. When you have submitted that, it will be aproximately 90 days till he recieves the Temporary employment authorization. He has to do a biometric getting his fingerprints done and a photo taken for the card he will recieve. So it will be a while till hes allowed to work. All the best on your journey! :)

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Go through the AOS guide and work with your fiancé to make sure you have all of the documentation needed for the AOS/EAD/AP including any translations of official documents.

The fees are listed here > http://www.uscis.gov/i-485

The fees for the I-765(EAD-work authorization) and I-131(AP-advance parole for travel) are waived when filed with a pending I-485, so include both of those too. It takes about 60-90 days to receive the EAD/AP combo card, which will allow you to work(along with an SSN) and re-enter the US when traveling abroad while waiting for the green card approval.

You need all the supporting documents for each form as well, so read the instructions for each one. You can also search here on VJ for what to include with each form if you get stumped. There are also example forms here on VJ you can look at when filling out the forms. They can be helpful.

I'm more confused now. So, we're planning to get married in the beginning of November in the US and then January we travel to Mexico to have a religious ceremony and honeymoon. Are you saying he will have trouble re-entering the US if he didn't get his green card yet?

Someone please help :(

your fiance cannot travel outside the US until you apply for adjustment of status and get advanced parole or he will not be allowed back into the US. You need to do your research

He cannot leave and re-enter the US without first obtaining AP(Advance Parole) or the green card(permanent residency). The K-1 visa is a one time entry visa. It is null and void once used to enter the US to marry. When you file for AOS, you file for the EAD/AP at the same time. If you leave before having at least the AP, then the AOS will be abandoned and you will need to file for a spousal visa in order to return to the US.

The EAD/AP takes 60- 90 days to receive, so you may want to adjust the dates in order to make it all work for you.

Okay, when he gets here to the US, the next step is to get married before anything else. You will then apply for Adjustment of Status (to get his green card.) With the AoS petition, you can file two other petitions concurrently at no cost (I-765 and I-131) which is for his Employment Authorization Document (EAD) and for Advance Parole (AP) respectively. With advance parole, he is allowed to travel outside the US during the AoS process. Without advance parole, if he leaves the country, you would void the AoS process and be out $1,070. Try to adjust the time frames for the weddings if possible. As others have said, AP could take around 90 days to obtain after filing everything.
