I'm another one been holding by background check

Timeline

Filled my n 400 on 01/21/2015 together with my wife,we did the fingerprint together,it took 3 months for her to become citizen.

On my case I haven't heard anything,last week I went online and filled a form for case status update ,I received a letter yesterday from the uscis saying the my background check its no complete,I never had problem with the justice system not local, not federal.

I called the Fbi and they said that my finger print check was done in march and returned to the uscis 3 days after,also i request my name to be check by the Fbi,and came back No records,so it means that i have a clean ,clean record,and i dont understand why the uscis are hold my application, and i dont want to be another one that gonna wait for few years to get my application back.

What should i do?hire a lawyer and file a lawsuit against uscis? Make infopass appointment?

I appreciate if someone with experience could give some advice.

Make an appointment to explain your situation with the office of your US Senator. Cheaper than a lawyer, and possibly more effective.

Second marriage to the Love of my life on August 5th, 2006

Son born on August 26th, 2009
Deported/Removed from the US on August 19th, 2010
Filed an I-824 (01-06-2011)
I-824 Approved (01-21-2011) and Forwarded to NBC
Email From The NVC (02-07-2011) Case Received and Case Number Assigned
AOS and IV invoices fees on February 11th, 2011
AOS and IV invoices fees pay on February 14th, 2011
AOS and IV Documents requested by the NVC on February 15th, 2011
AOS and IV Documents sent to the NVC on February 28th, 2011
Case closed on March 15th and Sent to US Consulate - VISA INTERVIEW ON MAY 4TH, 2011 AT 7:30AM
VISA DENIED FOR UNLAWFULL PRESENCE ONE YEAR OR MORE (QUALIFY FOR WAIVER)
Waiver of Inadmissibility filed on May 11th, 2011 in Yaounde, Cameroon.

Contact the senator's office from your state and explain them the situation. They usually help promptly with immigration matters. Also contact USCIS Ombudsman at http://www.dhs.gov/case-assistance

I dont know have you solved your issue or not, just want to share my experience. I believe they process the application longer for male than females. Here's why.

My family of 4 sent our n400 in late November and early December 2014 USCIS had received them. On January 6,7,8 three of us had fingerprint appointments (my sisters application was returned because she didn't sing it, but next month she also did fingerprints). Did that. My mom in less than two months had Naturalization test (and oath in the same day). Soon after her my sister that had her fingerprints done after me and father also became citizen. No words about me and my father.

Finally in May I received test date - June 25. After week or two I got another letter saying my test is cancelled "due to unforeseen circumstances", then two weeks after I got new date -July 7. Went there passed test, and yesterday received my passport.

Now my father. After I received my first date, he also got one, I dont remember date. Then (even though first one wasn't cancelled) he received new date- also July 7. Then on June 4 his appointment also got cancelled "due to unforeseen circumstances". Since then, that's almost three months, we haven't heard anything about his application. We called 800 number. First time they didnt say absolutely anything, then last week I believe we called again -person that was on phone said she sent to Office processing his document message about it being cancelled and check what's going on and send us new test date. She said if in one month we dont receive anything call 800 again.

I'm still waiting, went to the Senator office, filled a petition also I went to the House of federal Massachusetts representative and filled a petition to find out on my behalf what's going on with my background.

Yesterday I also filled a petition on the website of the Immigration Services Ombudsman.

I guess ,I have to wait and see if any results will come,I hope

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Timeline

After contacting the Senator office and the federal House of Representatives in Massachusetts, my case was updated today 8/28/15 to In line for Interview, 6 months after fingerprint was done.

Hope it will move smoothly now.

That person hasn’t visited VisaJourney since 2015, so I wouldn’t expect a response! ;)
