I-485 / I-765 NOA Timeframe and Expedite Request

Timeline

I recently filed forms I-485 (Application for Permanent Residence) and I-765 (Employment Authorization). According to tracking, they were received by USCIS at Chicago Lockbox on 8/17/15. My I-130 was approved on 12/20/2014, so I didn't file it all together.

Can anyone share how long it might take to receive confirmation they've received it and / or Notice of Action? I filed an expedite request with the I-765, and have a job offer. I'm trying to figure out if I'll be able to work.

I know if the expedite request isn't accepted it'll take 90 days for work authorization... Just wondering how long they'll take to consider my expedite request after receiving the package.

Any information would be greatly appreciated! Thank you.

Hi.

I'm not sure the request to expedite I-765 really works at the moment you filed your I-765...


If you already have your I-765 receipt number, make a phone call to Customer Service with inquiry to expedite your Employment Authorization. They will ask you a reason to expedite. Pick financial loss (pending job offer). They will give an inquiry number.

You will have a confirmation of your service request the next morning via email, or within 5 days (some times it takes longer) - if it's going to be a regular mail. Also in this email/regular mail they will tell you the STATUS of your service request - denied or under review.

If it's under review, you will be asked to fax proof of your Financial loss, such as proof of a pending job offer. All documents should be submitted with an official letterhead AND - be ready to fax it quick, at the same day you received an email or letter. After this your I-765 status should be changed within 72 hours (card in production).


My son and i (K1/K2 AOSs) have done this recently and had no problems. Our I-485 are still pending :( and we had to renew our EADs. We are both full time employees and we requested to expedite our I-765s to keep working without any "pauses".

I received an email, son - regular letter. We have sent cover letter and letterhead facsimile along with proof of current job.

  1. it IS a financial loss. And the letter/email they send to you says: "Please fax proof of your financial loss, such as proof of a PENDING JOB offer, to the following number:XXXXXXXXXXX, Attn:xxxxxxxxxx ". It is literally.

Typically, they will respond to expedite requests within 30 days. In my case they took 15 days to approve the expedite request and the EAD cards were produced two days letter. In the case if I-485 expedite, they took slightly longer (about 27 days) before they sent the Welcome Letter and ordered the card for production.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
