Timeline

Hello,

I am anticipating some problems here.

My wife (the US citizen) has been living in France with me since 2012. She only left recently to find a job in the US so we can move together. We have sent i-130 and received NOA2. Since I a preparing the AOS and IV packages, I see a potential problem.

She has not filed a tax report as of yet. She might have one from before 2012 when she was a student but I am not even sure this is the case (she did work at the same time). Will the pay stubs, letter from employer and a cover letter explaining why she has no tax information suffice?? (I am already deading the answer).

Thank yu for your detailed answers, I would love to hear from people who faced the same situation too.

USCIS I-130 Petition

02/04/12 Married in France

08/07/15 Sent i-130 package

08/11/15 Notice date for NOA1

01/04/16 Notice date for NOA2

NVC Processing

01/29/16 NVC Case number and IIN obtained by phone

01/30/16 DS-261 submitted and AOS fee paid

02/06/16 IV fee paid

02/12/16 DS-260 submitted

02/16/16 AOS and IV packages sent

03/22/16 NVC requested additional document (ACRO UK police certificate)

04/03/16 NVC received additional document

05/10/16 NVC assigned interview date

Interview and US embassy

06/01/16 Interview - Additional AOS support documents needed :(

06/12/16 - documents sent and received by embassy

07/09/16 - IV received!

Post arrival

07/26/16 - Arrived in the US, delivered the embassy package to custom officials

present - Waiting for permanent resident card

If she wasn't required to file, then she can submit a letter indicating why she wasn't required to do so. If she was required and just didn't (which sounds like the case), she needs to file back taxes.
