Visa denied after 19 months of wait

Good morning, I was denied my cr1 yesterday, Co said I can file for for 221 g but not until they return my documents to uscis, and that could be 6 months or more and I should not contact them till they do so,I want to know if any of you has been in this situation before, and if you were told the same thing and how you filled for the visa waiver, and the kind of process you went through, where you had it done and what will happen after it's been filled, thanks in advance

Call your senator or representative,

Ask them to find out why you were denied. Your senator will ask for you to sign a PLA then you will hear back from your senator.

They will find out the specific reason written on your file, then you can prepare your evidence so that when you case comes back, you can present your evidence to USCIS to have your case sent back to Ghana.

If everyone who was not given the a fair chance to represent their evidence or who was unfairly treated by CO was reported, some of these COs with such gross disregard for applicants will be out of this embassy and competent people put in place.

I did it but my case is K-1 and unfortunately, K_1 does not get a review.

Either you misunderstood or the CO is nuts. You can not file for a 221g. The 221g is a form / paper they give you which should

list the reason you were denied. What exactly does the 221g paper say ? Misrepresentation ? Where you ever in the US before ?

If you were told you can file a waiver then my question is for what reason ? What waiver ...waiving what ?

You need to be specific to get detailed answers in regards to what the CO had a problem with and reason for denial.

Not all embassies give out the 221 g, some just say denied

and people, like those from Morocco, have had to ask USCIS what the 221 g said and get a copy

just to let you from other countries know

you will get a paper telling you about an appeal which also has a fee

This is incorrect. There is nothing to appeal.

The petitioner will not get a paper about an appeal as the petition has not been denied, only the visa has been

refused. A CO can not deny a petition, he can only refuse to issue the visa and return the case to USCIS with recommendation to revoke and only

USCIS can revoke a previously approved petition.

USCIS sends the petitioner a NOID/NOIR letter and the petitioner then can submit evidence with a rebuttal and overcome

the reason the visa was refused.

If USCIS is satisfied with the NOIR response they will send the petition back to the consulate where the CO either approves or again returns it.

The OP mentioned a waiver was suggested by the CO, however he has not yet made it clear what the waiver request would be for.

Waiting to find out if OP will come back with clarification on why he thinks he needs a waiver and what type of waiver.

Before people, who may read this, with a returned K1 feel hopeful about what I wrote, please note that ONLY spousal visas get this second chance

to respond to a NOID/NOIR letter, NOT K1's, they expire and another petition would have to be filed. There is nothing to appeal unless a

procedural error has happened and the burden of convincing the CO and IO is on the petitioner and beneficiary.

and you went to a copy shop or internet cafe nearby,

and you scanned all of these docs

and emailed them to your petitioner.

Look, this is easy. You had an interview. You failed it. The Vice-Consul gave you stuff/paperwork about yer failure. You should scan all, email to yer petitioner, get petitioner's input. That's it, That's all. To not involve your petitioner smacks of Visa Fraud in Africa - which not only _SUCKS_ - but - no one wants to step in and help ..

Of course no waiver is required for that.....giving OP some time to regroup from the shock and time difference to respond and clarify what waiver

she is talking about.

IMO, the Vice-Consul saved the Petitioner a round o pain. You know that, dWheels. Pain Sucks, and not in a good way. 5 years of Nigerian reports - lets transmorgify them all to Ghana - same crup, different country, same rules for fraud.
