Custodial child to United States from Pakistan

Timeline

Me and my sister in law r us citizen and want to bring my 2year old nephew from Pakistan.his mom and dad give us custody he has autism and pakistan has no well treatment.will u please let us know wat paperwork we need wat form to fill and how many months it takes to bring him here once we had custody from Pakistan.

Timeline

You have to have the formal custody/adoption of the child(nephew) granted by a court or a government entity in your country and not just by the kid's parents. Then you have to be with the adopted child for a minimum of two years before you can apply for adoption based immigration.

We are going through the Pakistani court to gave us a physical custody of the child once court give us the custody then we r permitted to remove the child from the country.the child is my nephew do I still have to spent two year with him.we need to get him to United States as soon as possible for therapy he has autism there is no time to waste for this child.

Without adopting him legally and the two year wait there is no path to immigrating this child.

There is a difference between you being allowed to remove the child from Pakistan, and you being allowed to immigrate him to the USA.

You need a full adoption (not just custody) to be able to petition for an immigration visa for him, and then have two years pf physical custody- ie you'd need to go live with him.

Your other option may be to look into private special needs schools, and whether they can get you an I-20 so he can get a student visa, but that is not permanent and you'd need to pay a lot of money for the private school.

There is no formal adoption process in Pakistan only custody due to religion.

Read the link I previously posted. It's not going to happen the way you're hoping to. I can sympathize as I have twins with autism. But the laws are the laws.

You can get a B Visa for Medical treatment, having said that I am very surprised that you can not get treatment in Pakistan or India or anywhere else that will be a LOT cheaper than the US.
