please help what does this mean we are cut off?

Please help my sister she was married last year to a us citizen and application was received in september of 2014. Last inquiry about the progress and this is what they send back. What does this mean?

EXPLANATION OF NUMERICAL LIMITATIONS ON IMMIGRANT VISA ISSUANCE:

Immigrant visa processing is governed by the Immigration and Nationality Act (INA) of 1952, as amended, which controls priority dates and the number of immigrant visas that can be issued under certain preference categories. To establish which petitions are eligible for visas, the Department of State issues a monthly publication called the Visa Bulletin.

The Visa Bulletin provides a list of cut-off dates that are used to ensure the number of immigrant visas issued each year does not exceed the legal limit established in the INA. Cut-off dates are categorized by foreign state of chargeability and preference category. Only a petition with a priority date that is earlier than the cut-off date is eligible for a visa and consular processing. Please note this petition's priority date, foreign state of chargeability, and preference category can be found at the end of this correspondence.

The NVC may begin processing this petition prior to a visa number becoming available per the current edition of the Visa Bulletin. This allows ample time for the petitioner and applicant(s) to obtain and submit all required fees, forms, and documents. This petition, however, will not be eligible for an immigrant visa interview until its priority date is earlier than the cut-off date established in the current edition of the Visa Bulletin

This letter means they think the petitioner is a green card holder not a USC.

Yes he is a USC and has sent everything including his US passport to them proving so. I wonder how they can overlook this.

There must be some sort of mistake with the application. If they kept the copy for themselves have them review it because US citizens do not have a waiting period for a spousal visa

Family sponsored preference categories are limited to a minimum of 226,000 per year and employment based preference visas are limited to a minimum of 140,000 per year. In addition, there are limits to the percentage of visas that can be allotted to each country.

so, one thing you wait for is a visa number to be available.

I still don't understand what does this really mean. If something was wrong with the application they would have let us know not send this email. It's very confusing and it doesn't help the website they gave in the email isn't working.

i am currently trying to get on the phone with the NVC.. where in the email does it specify that we have to wait for a spousal visa because they think that i am a green card holder?

It simply means that they are out of visas..so they will keep your application until they have visa numbers available.

There is a quota for the number of visas to be issued. They generate the numbers and they do run out quite often. When it happens they put applications on hold until the visa number is available or they are sure there will be enough for any application underway.

When my mum went for interview years ago, the CO told lots of Liberians that there are cases that are still waiting for visa numbers so it is up to them to either pay the fee and hopefully, visas would be available or wait until when contacted to come to the embassy.The Liberians were been processed in Ghana interview due to the civil war in their country and the immigrant visas has ran out.

Unless something has changed, immediate family members of US citizens(spouse, kids under a certain age and parents) do not wait for a visa number.

I believe this is an error, however it's weird that you both are dealing with Jamaica and received the same letter around the same time. If you kept a copy of the application please review that you did not accidentally put you are a green card holder.
